Cop Attempts to Ticket Motorist for Speeding without knowing Speed Limit

 

 

The cop didn’t know what the speed limit is BUT he knows he was going 10% over the limit. Amazing precision amidst ignorance.
7:45 – if I was a traffic judge, as soon as the officer said he didn’t know what the speed limit was at that point, I’d instantly dismiss the ticket and reprimand the officer. How do you know he was going 10% over, without radar, and without knowing the actual speed limit?!
Instead of just owning the mistake, he knowingly backs his officers lies with more lies, and they wonder why citizens don’t like them.
Cop admits when retelling his story, “I pulled you over BECAUSE of the phone.” Proof they hire the dumbest people they can find.
The worst part about a ticket like the one that could have been issued is that the officer wouldn’t show up to court so he wouldn’t have to be wrong. The police get paid overtime and get promotions based on tickets given, not convictions.

Would it kill a supervisor to just come out and say “yeah, my officer was wrong. I’ll explain to him what he did wrong so it won’t happen again. Have a good day. You’re free to go”. No citizen would EVER mind hearing that.
Nope, almost never. They don’t want to deal with the civil liability (even though it’s our tax dollars that would be used in the settlement). So they will double down.
Ego won’t let them
I’ve very seldom heard a cop or other government employee admit being wrong or offer an apology.Their egos are to big.
The whole issue here is that once a cop says something no matter how stupid, he feels like he has to stick with it. No matter how stupid, no matter how you prove he was wrong. And the supervisor has to back him up no matter how petty and trivial the matter is.
Show the cop he’s wrong, he immediately moves the goalpost. Lying is all they know.
How that didn’t escalate into being ripped out of the drivers seat I’ll never know. Well done. You stood up for exactly what you felt was right.

The camera is why, obviously. No cop will obey the law when nobody is looking. But some of the smarter ones will obey on camera.
The cop completely lost the argument when he admitted he didn’t actually know what the speed limit was. How do you know if someone is speeding if you don’t know the limit?
If the cops are ever harassing you, just run inside the nearest school. They will never enter a school to make an arrest.
Cops needs to be fired immediately. The sergeant even was making fun then tried to fabricate an id infraction.
What a waste of resources, I’d ask him to write me that ticket for 2.5mph over the limit, just to watch the judge call him an idiot. No judge is going to uphold 2.5 mph speeding charge based on visual estimation, and they should be pissed at any police officer who thinks that is worth the courts time.
This, even the pettiness and/or small impact, is a bridge event. Take nothing, give nothing. If the cop pushed at the 10%, and demanded identification, and went ahead and wrote the ticket… seems like a slam shut case of 18 242, especially with the 30 mph signage. Unfortunately, statistics on bad arrests/ unfounded ticketing/ ect. are not provided.
First said the guy was on the phone and officer said my mistake then the officer didn’t even know what the speed limit was. This officer absolutely is pulling people over for no reason. Then lie a officer that does this is corrupt period. Should be fired.
I’ll tell you exactly why that 2nd officer let him go. Because he knew that a man driving a Ford Raptor probably has the money to fight them and sue them.
It’s the camera. They can’t seize the footage, so they know they will be caught.
He should have mentioned to the “stupervisor” that’s the cop assumed he was going over 10% of the posted speed limit, but the officer couldn’t tell him what the speed limit was.
“We can stop you to check your license.” If that’s true we are all screwed.
he forgot to mention they can initiate a stop on a whim, then demand identity papers. It’s down to the character and fortitude of their target whether there is challenge to the validity of the stop…
Ironic how the officer stated that he was driving over the speed limit, yet doesn’t know the speed limit himself. He then states with 100% certainty that he was driving 27.5 mph, and then we find out the speed limit is 30 mph.
 @Michael Dose  Arkansas is a stop and ID state on one condition and that’s loitering!! They will use that everytime to get your ID!!! You can park your car in Walmart parking lot, immediately get out and walk to the doors and they will call that loitering just to ID you!!! That is no joke!!!

I don’t know of any which allows them to arbitrarily pull people over in Texas. However, Texas is the ONLY state I’m aware of that has a law which allows officers to take ANYONE to jail on ANY traffic infraction. It is of course officer discretion but I don’t know of ANY other state with that law. If I’m wrong I would like to know.

Cops: “Why does everyone hate cops?” Also Cops: “You are obeying the law and I don’t like it. I’m going fish for a reason to arrest you.”
Imagine being a cop and thinking “Wow, this guy is driving awfully safe… I better make sure he’s not drunk!”

What brings you to this part of Texas? Like it’s illegal to drive from Austin to Plano or something. And now that he pulled him over for no reason he’s trying to bust him for the rental car lol. It’s like if I can’t get you for being too safe I’ll just find a reason. Boy this cop really wants that promotion for most tickets given out. He’s as bad as a used car salesman.
He realized the guy was okay when he talked to him. His ego just wouldn’t let it go.
I got stopped for “driving too safe” once. As soon as the officer came over, he asked why I was driving like that. I asked him what he meant. He said I was driving “suspiciously” safe. I facepalmed in front of him and asked him if driving safely was a crime. He didnt say yes, he started beating around the bush by saying “im the one asking questions here”. I stayed silent the rest of the time. I didnt commit any crime and I didnt answer any more questions. He eventually got bored after a few minutes and left
“I’m just pulling you over to make sure you are okay.” “You’re okay?” “Cool, here is your warning. Fantastic dialogue right there. From what I’ve seen on this channel, open dialogue with a Police Officer isn’t friendly or polite, it’s basically phishing. Who can blame people for only complying with the bare legal requirements when engaged with a Police Officer? Any further and you are a successful mark. When did Police Officers become street magicians? “Look here, see how you are a lawful citizen? Bam, now you’re a criminal, hands up.” Sad and appalling.

 

What erodes our confidence in officers is knowing that the good ones know what the bad ones do and are doing, but won’t blow the whistle because of the brotherhood.

 

this is the equivalent of pulling somebody over for coming to a full complete stop at a stop sign. nobody stops at a stop sign, it was suspicious behavior.
it’s so weird how cops spend most of their time giving our bs tickets and harassing people when they could be focusing on things that actually matter like, actual criminal things.
I thought he was doing a reasonable stop. Then he said “I’m giving you a warning, please give me your papers”. And like that, a reasonable stop turns into a power trip. You made your point, let the man get on with his life.

 

“Why were you driving 60 in a 75?” “Because I saw you behind me and I’m terrified of stupid, unreasonable cops.”
“Your behavior is consistent with someone who’s intoxicated” He saw he wasn’t intoxicated. Thats where the stop should’ve ended.
“You’re getting off with a warning”, then proceeds to ask tons of inconsequential questions. Typical cop behavior, trying to implicate a person for a crime.

 

This is literally the meme of, “Do you know why I pulled you over?” “But officer, I was going the speed limit!” “Exactly. Go 10 miles over the speed limit or go back to whatever state you’re from.”
One of the things that my driving instructor told me, that has stuck with me decades later is this: “The speed limit is the MAXIMUM speed you can travel, under absolutely PERFECT driving conditions”. Meaning, if it’s raining, traffic is heavily congested or any other number of factors, you should probably be going UNDER the max speed.

In 1994, I learned firsthand how some police departments definitely have a “quota”. I had been severely injured in a car accident the year before and had been unable to work. The tags on my truck expired but I didn’t have the money to renew them. I was literally on my way to my first job interview in more than 10 months when I was pulled over for expired plates on the 29th of May. I explained the situation, but the cop was unsympathetic. He wrote me up for four tickets, three of which were centered around the expired tags. The fourth was for not wearing a seatbelt. I went to court and when the judge read off the tickets, one after another, everyone in the courtroom was snickering. When she was done she simply asked if I would like to speak to a deputy D.A. I said yes. He was a very nice young man who gave me a chance to explain the circumstances, and I was able to show him that I’d since renewed my tags after getting the job (despite being late to the interview). He said that three tickets for one minor offense was unreasonable and dismissed them. Then he asked, “Tell me honestly, were you wearing your seatbelt?” I said, “No, I wasn’t. “ He thanked me for my honesty and charged me $10 for that. Yeah, quotas absolutely do exist and they shouldn’t.
“Where ya headed?” “That way” “Where ya coming from?” “The other way.”

 

It is not unlawful for the police to interrogate you during a stop or even a regular conversation. If the driver would have known at the time ; he could have stopped the interrogation cold. At anytime you can withdraw your implied consent to be interrogated without an attorney present. He was under no obligation to provide the officer details not pertaining to the traffic stop. He should have invoked the 5th.

 

When police ask you to sit in their patrol car passenger seat they want to better assess if they can smell alcohol and/or get you to say something incriminating, FYI.

Why do cops always ask where you’re headed or where you’re going, as if it’s any of their business or you have to justify or explain your movements to them? I love everything I’ve learned from this channel, and I’ll definitely keep in mind the myriad things I’ve learned in any future dealings I may have with law enforcement.
When you hear “I just wanted to make sure you are okay” you know they are gonna harass you for no reason what so ever
I remember hearing a prosecutor say in court that he would prosecute someone driving 46 mph in a 45 mph speed zone. This makes us distrust the legal system if we are stopped for going too slow.
The problem with “your right to silence” is the following. “So, what’s your name ?” “I’m invoking my right to silence.” Officer steps back for a second and thinks to himself, “I am going to get this fuck arrested for something before the day is done, I promise you.
Cop: “You were driving a bit slow. Tell me everything about yourself, then drop your pants”
.. Most people, esp. green card holders, do not understand this. Police are intimidating; and a police officer can ruin your life. People will often just comply to avoid any resistance, and can you blame them? I can’t.

Driving too slowly impedes traffic and creates a safety hazard. So stop a vehicle in that lane for several minutes. Roadside traffic stops are generally more unsafe than the behavior that caused the stop. Laws need to be changed to require officers to direct drivers to a safe location.
4:38 “What brings you to this part of Texas besides that your car broke down?” Does the officer have the right to ask this question? This whole stop is very confusing.
They have the right to ask whatever questions they like. They’re just hoping their victims are ignorant enough to answer.
Sure he can ask…its a dumb question from any perspective even if the guy was holding up banks on the way and mowing people down GTA style it would still be one of the dumbest and most pointless questions to ask and to repeat the question…..as though it had any real value….beyond stupid.
They hope by extending the encounter it may bring other issues to light that they can then investigate for a possible crime.
 @John Romero  Yes, they can ask, but should they? Questions like this are great source of distrust between the police and the public. Questioning reasons why someone is somewhere sounds a lot like you’re not welcome there and creates atmosphere / feeling where people feel they have no right to the freedom of movement. Every time police officer is conducting their business they should also concider PR, how their behavior may affect people’s feelings and their sense of security, freedoms and privacy and ultimately the whole community.
That was a Gestapo Nazi cop style question.
 @Banjong Philaiwan  the more I think about it, the more it sounds like a visa question. So I’d be inclined to answer along the lines of “My permanent residence somewhere in Country X brings me to the State of Y” because the “business” / “pleasure” answers aren’t applicable unless you’re visiting country on a visa which is granted for the purpose of either business or pleasure. That’s pretty much my take on it although I’m not sure most cops really understand what it is they’re asking or what the question is for.

Most good drivers take it easy when driving cars they’re not used to. This cop is a nut case.

I’ve been pulled over for, and I quote, driving so proper for someone in a sporty car it was worrying. He followed me for 15 minutes before pulling me over.
That California license plate is perfect prey for quotas, since out of staters rarely contest tickets if they have to take time off and travel for court appearances. Easy revenue.

The officer actually encouraged the safe driver that he should be going 80 (10 miles over the speed limit), instead of 60 (10 miles under the max which is legal). I was waiting to see if he asked, ‘You’re suggesting I speed, officer?’
“What brings you this way?” The dude literally just told you. Is it illegal to have an accent in Texas yet? This cop literally told him he should be breaking the law rather than driving under the limit.
Speed limit has no determination on getting pulled over. Most States have laws concerning driving too slowly or too fast and even doing the speed limit they can get you for driving too slow/fast for conditions. What’s all that mean? No matter what there is always an excuse an officer can rely on to pull you over.

Here in San Diego, quite few years ago now, a cop hit a pedestrian, and he was speeding a little. It was explained to us serfs that speed limit laws are actually quite flexible, and the officer was doing nothing wrong.
The cop is like: “Can you say something illegal? I’m low on my quota.”
Man, I got so angry when he kept asking why he was there. The guy was such a sweetheart patiently repeating his answers over and over
I was told by multiple NY state trooper pals that driving at the speed limit is very suspicious behavior. They want to see you going 5 to 9 mph over the limit. 10 mph over is too much. Those are strict guidelines that differ greatly from what we were all taught.
This exact thing happened to me, I was doing 95 in a 100 Kph zone and the officer said that people typically go 115 or more. I actually asked, “So why did you pull me over rather than someone actually breaking the law?” He then informed me that he could write me a $200 ish ticket, I pointed out that his name would be on the ticket and that would make filing a complaint really easy. He straight up walked away without indicating that the stop was done and just hoped back im his car and drove off. It is also worth noting that as I pointed out the complaint I gestured to my dashcam which wasn’t even set up properly at the time but just the thought that he had been recorded saying he pulled over a person following the laws rather than the ones that were actually breaking them was enough for him to leave without incident. He definitely suspected me of being intoxicated as his questioning reflected that but I very clearly wasn’t and there is no point in prolonging the traffic stop just to try and pretend that he had another reason.

“does it go on the record” -no in that case, what is the point? if there is no record of the warning, what would happen if another cop stops him for doing the exact same thing again?
I love the way you breakdown these stops. I think these worse be an excellent training tool in police academies. Show the video without the voice over, send them home with some work and analysis then breakdown the stop. This as a training tactic would save lives, money and rebuild trust. Thank you.

A police car tailing you with no lights is an excellent reason to slow down.
When the hell does a cop ever ask you to sit in the passenger seat of his car?! I would be sus as hell and probably refuse.
After watching a lot of these videos, I have learned you can not win with cops. Damned if you do and damned if you don’t.

The deputy may not have been “rude” but he was definitely disrespectful.
He was being a polite jerk. The man did obey and listen to the cop so that helped. Had he known his rights and laws and challenged the cop who knows. He should file a complaint. That warning shouldn’t be on his record.
I agree. It almost like passive aggressiveness, whereby the words are nice but the intent isn’t. You can be politely deprived of your rights and liberty. A bit like a smiling executioner!
Now I know why I’m alive. I have always treated police like they are crazy by remaining calm, not challenging them, and allowing them to overreach their authority when dealing with me, the dozen times in my life I’ve dealt with them.
He said “I just have to document my stop” Then he tells the man “No, this doesnt go on the record.” Since when was documenting something for the record, not putting it on record? He lied to a man who broke no laws, gave a warning for no reason other than to protect his failed pull over attempt, and looked for other problems in a case where he should have never even made a traffic stop.
Damn. Stopping the guy for no reason, interrogating him, even when he responds and explained why he is in that part of town, he keeps fishing. Even asking for the rental agreement. And they wonder why people hate police?
I have seen cops ride the rear bumper of a car driving the speed limit forcing them to drive faster. Then they give them a speeding ticket. Small towns in the mid west are notorious for this kind of “law enforcement.” They watch for plates from another state and pounce on them because they know the driver won’t come back to fight the bogus charge.
Although we have the right to remain silent, all I’ve ever seen on this channel when it comes to citizens remaining silent just caused more problems. I think he was in the right for cooperating with the officer.
That was a prime example of an officer going on desperate fishing expedition . . . and wanting to exert his authority.
The frequent braking was what caused the stop. I see this a lot around here and it’s because people drive with two feet. So you’ll see brake lights even during acceleration.
This reminds me of the time I was pulled over for driving in the far left lane on the highway. Mind you, the other two lanes were being paved, so it was the only lane left. Rookie cops…
Last video I watched on here was two drunk cops getting pulled over. Neither getting charged for being drunk with a firearm and the driver being allowed to go home after being taken to the station….meanwhile this guy gets pulled over and questioned for driving safely….there is something fundamentally wrong with the policing system.
A warning is like getting an incorrect answer on a quiz before an exam. There’s a reason this happened; maybe you misread a question, lacked domain knowledge, or maybe you ran out of testing time, et cetera. But it gives you something specific that you and your teach can correct, so you get it right in the future. With this warning for his “driving behavior,” there is no specific item for this man to focus on in order to subsequently avoid another warning or citation. (Perhaps he’s advocating doing 80?).
Audit the Audit gets an F, for failing to give this dummy cop the grade he deserves.

 @Ted Bell  I agree the cop deserves a F and I like freedom but refer to my previous comment. The man had a out of state license plate. The cop was hoping the man was intoxicated to search the vehicle. Any large amount of cash would be seized under civil asset forfeiture.
 @tonyetzu  He says what the cop did was questionably legal, which would be up to a court to decide. Based on past casee and current laws ata doesnt find it to be outright illegal. Just because you feel like the cop should get an F doesn’t me he generally should. Again everything was questionable and shady, but he didnt throw things like “it smells like weed” or just start searching the vehicle without consent. That’s why he got the grade.

 @MrPopo69zkai  he never should have stopped the guy for obeying the law (he wasn’t swerving or showing any other signs of impairment), he displays obvious signs of racism (“you’re not from around here boy”, questioning about his background, the prolonged questioning about where he’s going), and he repeatedly lies to the man to create fake justification and prolong the stop. Prolonging the stop is illegal as Ata states in many videos.

During my 40 years of operating a motor vehicle across 15 states, I regularly drive under the speed limit for safety reasons but have NEVER been pulled over for it.
I’ve actually been pulled over twice in this exact manner, but here in Northern Ontario, Canada. The police officer on both times suspected me of being intoxicated because I was driving slowly (~10km below the posted limit). The first time, it had been raining all afternoon in the fall, and temperatures dropped below freezing and I was driving cautiously as there was ice on the road, and I did not yet have winter tires on. The second time, it was snowing, and we were in town while hauling a very large trailer, and again just trying to be careful.
I always thought being a cop would be an exciting job but the more of these I watch it must be deathly boring
Why is the cop asking so many freaking questions? None of that is his business. This is crazy.

Man: “Get out of my car!” Lady cop: “Don’t tell me what to do!” What a child, sheesh. I wonder what she would’ve done if he had been more verbally aggressive.
Let’s be honest, they were going to find a reason to search the car no matter what. They weren’t traffic cops trying to give out seat belt tickets.
His last comments said it all. “They are narc cops, they don’t pull people over for seatbelts.” “The pulled me over because I am a white man in a black neighborhood.” This is EXACTLY what these fishing expeditions are all about. To quote my cop friends “We are like sharks, constantly circling, lokking for a reason to pull people over.”
If an officer accuses you of something and then doesn’t show up in court, you better not be liable for any lost revenue / court costs. I would be pissed.
The police really need more accountability. They shouldn’t have any type of immunity. They should be held to a higher standard, not lower
The officer says “relax” to the man surrounded by several people with (I assume loaded) guns and other weapons. I can only wonder how relaxed the officer would have been if the situation were reversed.
The “word” of cops has been taken for truth far too long! It is outrageous that the officer searched his vehicle without his consent and “after” he repeatedly said “NOT” to.
Cops telling people to “stay calm” after or while stripping them of their rights always gets me on this channel lol… The audacity!
They should get a F, for not turning over all footage when requested. To use their logic… Why not just comply with the request “if you have nothing to hide.”

“Officer safety”. The magic words that allow the cops to order, detain, search, escalate, abuse, assault, humiliate and retaliate.
I think you missed another point about officer safety justifying the search: once they removed him from his car, whatever might have been there was no longer a factor as he couldn’t reach it. By taking him out, maybe even closing the door, they assured their safety from anything that could have been there. Thus, the search, while perhaps legal by the letter of the law, exposes their likely intent to find more “dirt” on him and NOT about officer safety. The search reveals the stop to be almost certainly pretextual to try to find more serious crimes. Legal, yes, but not community-endearing.
The Courts allowing officers to search because they “believe” something, is in direct contradiction to the 4th Amendment. “You need a warrant, unless you decide for yourself that you don’t…then, no problem.” Makes zero sense.
Why were there so many officers present for a “seatbelt” violation? This was a pretextual stop for being in the “wrong neighborhood”
Police Departments MUST be overseen by citizen review boards. Additionally, all body cam videos need to be uploaded within 24-hours and archived by such boards in addition to the departments’ evidence database so they cannot go “missing” or be tampered with. I find it highly “suspicious” (one of cops’ favorite words) that the female cop’s body cam footage is one of the two missing from the FOIA request.
I love the inherent conflict between “people leaning over to the passenger side of their car” being a valid excuse for cops to suspect someone is hiding something and the fact that the glovebox, where most people keep their cars information, requires you to lean over to the passenger seat.
Should have received all 4 body cams, such bullshit to have a system to retrieve information and information can be denied when it contains the victim and may contain information that would put liability against officers or a department. We seriously need further protections and extensions to laws and systems to gain access to information, especially when it directly contains information relating to ourselves and interactions with law enforcement.
A lot of the time, it seems like ATA gives the police “outs” all the time. The idea that the female officer could use some obscure rule, when I’m almost certain she wasn’t thinking of it, gives off the idea to me that these officers can use videos similar to their cases to find loopholes and whatnot.
The supreme court really screwed us with this rule of cops being able to order citizens out of their vehicles for no reason!
So let me get this straight, when you are pulled over, if you act like a helpful, normal member of society and try to get your insurance out of your glove department while waiting for the cop, YOU CAN BE SHOT OR SEARCHED because of something far less likely going through the cops heads? … WHAT?!?
“Why are you acting like this? Why are you using the law to defend your rights?” This is really what they want to say.
Pisses me off how these officers are telling him to relax while they blatantly violate his rights.
She was already searching the car when he said he didn’t consent to it. True, he did eventually admit to getting his phone, but I believe he would still have a very strong case against the search.

Ah yes search the vehicle for “police safety” whilst he’s not in the vehicle and has already been searched and has 4 police officers surrounding him. Yes he lent over but he told them he was putting his phone up

Hell, if you walk up to a cop car you’ll have 3 or 5 cops wondering why you’re around their vehicles. They were illegally in his vehicle and they wonder why he was irate. Your rights are neutered when you’re in a car. It’s crazy how much leeway courts have given law enforcement over the years.
Every one of those cops are corrupt. They gaslit him and they told him to remain calm. And how did that one cop not know how to read an expiration date?
Officer: “I’m going to search this vehicle whether or not I get permission.”
4th amendment: “you can’t do that.”
Supreme Court: “you CAN do that if you don’t feel safe (hint hint)”
Officer” “I don’t feel safe so I’m going to search this vehicle without permission.” 4th amendment: “WTF?”
I love how cops will say “we are recording too” and then when you try and get the footage they some how only give you half the footage.
The problem here is that he lost his cool and never got it back. You make a lot of mistakes when you’re controlled by emotion. He was not thinking clearly.

Police have been taught that it usually has the opposite effect when someone is being violated. They say “calm down” because They want their victim to give them a reason to be violent.

Being that the individual was outside the vehicle when the search of his vehicle began, he would not have been in a position to obtain the weapon if he had one. This rendering the officers claim invalid as to officer safety. Have a great day 😊.
I love how they kept distracting him with the same questions repeatedly to draw attention away from the officer who they were not going to interfere with while she was going through his stuff. If I learned anything from this, it’s to keep a stash of uncapped hypodermic needles on hand just to toss under the seat as a deterrent for any such actions. One of the most offensive things is that cop who keeps saying “Just relax” and “Relax. Relax”. If I were a judge, I’d lock him up with a Lexis/Nexis computer and would not let him out until he printed out for me the statues that say “failure to relax” is a cri’me. That cop wasn’t issuing lawful orders. That cop was just on an ego-trip. There’s no law against not relaxing. He was clearly way out of his rights and just trying to make the subject kow-tow by issuing UNlawful commands. (And after the cop gives up and says “I had no right under law to tell him to relax” then I’d give him a trial for abusing his authority and throw him in jail for the rest of his life. And that’s because I don’t believe in the death-penalty. There’s just no excuse for bossing people around gratuitously just because it makes someone feel superior.
These guys tried soooooo hard to implicate him in admitting to “furtive movements 🙄” so that they can justify an unconstitutional search. Disgusting
Audit the Audit gets an F on this one. A furtive movement is one that “attempts to avoid notice or attention”. Leaning isnt furtive, its obvious and everyone pulled over leans to retrieve their wallet or ID. If anything Audit the Audit suggested were in fact lawful, every single movement in a vehicle could be considered furtive and warrantless searches would be common place as the 4th would be moot. The problem with taking a sentence out of case law is that each case is decided on a totality of the circumstances. In this case the police only had “leaning over”. They couldnt cite a violent criminal history or history of gun possession. They couldnt claim location was a hot spot of criminal activity. They couldn’t claim there was a high risk to the nature of the stop. They had nothing and likely the two body cameras they didnt send footage for showed the police intended to pull the car over to conduct a search, just like the guy asserted.
SO CORUPT! If a cop doesn’t show up for court they should never be allowed to be a cop because it shows they will use there power for bad and then simply not show up for accountability.

When I’ve been pulled over I’ve HAD to reach over to get my license and registration, as I assume most people do. Who has all that stuff in a spot where they can just grab it without reaching?

I’m pretty convinced at this point, having had similar things happen to me (getting pulled over and searched for drugs when there were not drugs or even suspicion of any), that cops just do this to piss you off/get back at you for something you said/inconvenience you. They know you won’t be busted for anything, but they know how to ring you through the system to make your life at least miserable and inconvenienced. And then there is a record that you had an encounter with them, which makes you look more suspect each time you run into a cop. I’m not sure if there is a name for this phenomenon. I just call it ringing you through the system. This is how they attack you without actually attacking you.

..  I always love to listen to police calmly tell citizens to “relax bro” – AFTER they have stopped, harassed, illegally searched, belittled, frisked, and made the citizen leave the vehicle and put their hands on the top of the car. In what universe does this silly expression, “relax bro” not serve to further anger a justifiably outraged citizen?

Reminds me of when I got charged with fleeing the scene of an accident, plus another half a dozen of bs charges and when I showed up to court. The state trooper never showed up and everything got dismissed.

The “protective search” of the car is straight bs and should not be allowed or justified. Being allowed to remove the occupants of a vehicle for officer safety and doing a terry pat down should be sufficient. In that case any police officer can use the argument, as what you used in this video, that the person(s) leaned over to justify any search of a vehicle where other items (“evidence”) other than illegal weapons are found.
I also believe they wrote the citation to jam him up and screw with him just for arguing. That citation is a straight up contempt of cop citation. Im sure like the driver in this video pointed out, those officers are not worried about seatbelt violations, though using any be traffic violation to create a legal reason for the stop.
It seems like the police could just say “I saw you reach for something” and use that as articulable suspicion to be able to search the vehicle, regardless of whether the suspicion has any factual basis.
He was out of the car when the search occurred. No way was this for officer protection. He could not reach for anything on the passenger side when he is outside and on the drivers side and controlled by two officers. They were looking for drugs or another reason to arrest him.
We’ve given government so much power that there’s almost no way to know if you’re in the right or wrong. There’s the 4th amendment but all kinds of exceptions to it. The fact that he can lean over in his own car and that’s apparently suspicious, is insane.
I do appreciate that the officers tried to calm him down and de-escalate after realizing they were completely in the wrong regarding the initial search. Though they SHOULD have apologized.
Here’s a thought, maybe police should stop doing “hazardous roadside encounters” if they are soooooo afraid of everyone that moves, and clearly violates the 4th amendment. That why it protect the police and keeps our 4th amendments intact. Just a thought.
So, all a cop has to do is “Claim” they saw someone lean or reach over and they can do a warrantless search. Nice to know we are safe from accusations. Even if the claim had been true, they could have asked him to step out for their safety. Confirmed he was unarmed and then proceeded with stop as normal. Instead you have 4 cops for a random for a traffic stop? Four? And one immediately opens the car and starts searching rather than a cursory visual inspection from outside that would be more than enough to verify if a weapon was present. This was intentional instigation. On top of that the woman couldn’t even read the insurance right, or was lying in order to enter and search the car again.
Ugh, so much ambiguity built into the law to protect police corruption. “I smell weed” “You leaned over” All subjective, requires no evidence, and leaves the door wide open for them to do what they want, regardless of actual observable facts.
This is what everyone is overlooking, he was stopped in a black neighborhood . that means those cops are doing the same thing every day all day to that community. Every black person that interacts with these cops are not criminals….and just imagine is this was at night.

When I first saw this and saw plain clothes officers all ready to go I knew it was a prejudged stop. They knew what they were trying to do.

Let’s get this straight as I hear this a lot from people being harassed by cops. They’ll say ‘In a hard working American with a job/ business. I pay my taxes’ etc. It does not matter if you are. It does not give your Rights any more juice than a unemployed homeless person.
I get what you’re doing by clearly breaking down the letter of the law, and it is often helpful. But It would really lend your channel a lot more credibility and popularity if you would point out how some case law and even supreme court rulings clearly fly in the face of the spirit of the constitution and are outright tyrannical in nature. Any excuse to search a person’s vehicle without a warrant are plain examples of this. The idea that officers safety outweighs the safety of the citizenry is itself a crime. Do better man.
Seems like the courts rule to give the impression of freedom’s while leaving enough loopholes so the police can act with impunity. You act like the police know the law, whereas I feel they know that they can do whatever and will find a law/create a reason to back them up later.
The female officer searched his vehicle not on direct suspicion of a crime having been committed but instead trying to see if a crime has been committed. Shame on these cops and I hope the lawsuit is fat.

When he said “You want to see what I was leaning over to get… it was my phone!” he was only repeating the words the cop used, not admitting it himself. He follows it up with “it’s on me.” Meaning it was in his pocket and not on the passenger side, where they claim “he may be trying to hide something.”

Because I’m white in a black neighborhood” this actually happened to me and the cop pretty much admitted to it outright during the stop. In 2016, my aunt was working for a company called Niantic and she convinced me and my mom to check out Pokemon Go. I kind of got into playing it for awhile😂 there was this website that showed where rare Pokemon spawns were and a rare Pokemon was spawning a few miles from my house in a city called Inkster. So I drove to the area and was trying to find the Pokemon. I was driving slowly down a rough street, where the stupid Pokemon should have been but it didn’t spawn so I drove around the block

As I was driving, I got pulled over. It was daytime, but the cop claimed he pulled me over because the license plate light on my SUV was out(which, it was my mom’s car and I didn’t even know she had one, my car didn’t. It isn’t a requirement to have) He asked me to step out of my vehicle and offered to show me what he was talking about and then asked if I minded if his partner “took a look around in the car”

I was naive, dumb and terrified. I thought if I said no they would suspect I was doing something wrong or hiding something so I said sure. We got to the back of the car by the license plate and I remembered the car was off so he couldn’t show me the light. He began asking me who I knew in this area, which house I was going to, I said I did know someone who lived like a half mile down but I wasn’t going to anyone’s house and explained that I was looking for a Pokemon and he said “Oh that explains why you were looking at your phone when you stopped on the street back there” He told me this was a bad neighborhood, that I didn’t “exactly look” like I “should be here” and he made it very clear that they thought I was here to buy drugs. As if that is the only reason I would possibly be in a predominantly black neighborhood 😤

Once they finished casually poking around in my car, they told me to start the car and they go “oh look at that, your license plate light is working again, you don’t need to worry about getting it fixed”. I was baffled. They lied to pull me over. When I was a teenager my boyfriend’s cars brake lights were shorting out apparently, we got pulled over and the cop just let us know that our brake light was out but when we went over the railroad tracks, it turned back on and that it was probably a wiring issue and gave us a fix it ticket. These cops were telling me I didn’t need to worry about the fact that the light was magically working again. It was all very weird

99% off drivers have their insurance and registration in their glove box. So anyone who reaches for that stuff before the cop walks to the car gives the cops reasonable suspicion to search the car I guess

Not really sure how an “officer safety” search can be valid…ever. Once they removed him from the car and patted him down, any weapon he had in the vehicle is no longer accessible.
Regardless of if they had reason to be suspicious of him, they still continue to blame him for the incident and tell him to calm down, rather than just admit their suspicions were wrong.
People gotta remember that there is a law called deprivation of rights on the color of law. It is a federal crime for any person who can utilize the law to deprive you of your rights while under that color of law. A violation of your rises also a deprivation of your rights. This is punishd between one and 10 years and a federal prison. If a life is lost during the deprivation of rights then the death penalty can automatically be on the table at the federal level. You have to file these charge with the feder yourself. It is time we start filed these charges with every single deprivation of your rights. Also when I please have some breaks the law starting system the weapons related charges are also included. Because the more they broke the law there in Alanna protected by the law or at least should not be which means, their possession of firearms while committing crimes! It’s time we start holding them to a higher level. Nobody’s expecting them to be perfect and above reprieve. But knowledgeable of the law respectful and professional, hell yes!

 

However when the officer asked him to get out and he willingly complied, they lost all right to enter the vehicle. Since he’s now outside the vehicle, there’s no reasonable assumption for him to be able to reach the supposed weapon they thought he was hiding. Therefore they have mitigated officer safety by removing him from the vehicle instead.
I believe the fact that not even one of the four officers showed up for the court date says about all we need to know about their case and how well it would stand up against questions in court.
My lawyer is filling a motion to suppress as I type. I was never charged with the reason for the stop (Invalid plate). Because they were valid. The DMV even sent me a certified document agreeing with me. Pulled over in 2018 Document received in 2020 Motion filled in 2022 30 court dates 1 public defender quit because he didn’t want to file the motion! If I had money for a real lawyer this would be history. If you’re still reading this ..my charges are driving without a license and possession of paraphernalia (pot pipe) In my defense….you can’t get fruit from the poisonous tree. In the last 4 years I’ve learned a lot from videos and if I could do it again I’d ask for a supervisor and have them run my plates, then I could have caught the officer lying on the spot! I was on probation and a registered co-owner of the car. Yet the cop said no name was associated to the plates. And yet here I am 4 years later with the DMV ( a State entity) saying the plates were legal, trying to defend myself from the State. Morale of the story….if you want things done and you have a public defender…you must do them yourself. They won’t defend you, all they will do is represent you.
Did u know that it even turned out that their reason for the stop “the seatbelt” wasn’t even valid and this was based on where the cop was at the junction as dpn passed him because there was no way he would have been able to see his seatbelt from the passenger side window as he passed the crossroad where the cop was stopped at the traffic lights to his right! THATS probably the reason they didn’t turn up in court, because they knew the stop was bullshit in the first place! 🤬🤬🤬🤬

“Officer safety”, that is the most obscene excuses used to justify illegal searches and detainments by LEOs.
Clearly an extremely controversial search of that man’s vehicle, over an alleged seatbelt violation. I’m a retired police officer and before I search someone’s vehicle, certain parameters need to have been met. What these officers did was uncalled for, unprofessional and likely illegal. The officers, based on the number of them and how they were dressed, seemed to have been on a fishing expedition that went horribly wrong for them.
I guess all vehicles can be searched when drivers lean over to get their documents out of the glovebox.
I didn’t know that driving while white was a thing. I guarantee this guy was not pulled over for a seatbelt violation. I also guarantee that the cops wish in retrospect that theyhad taken a pass on playing with this guy. He was a handful for sure.
Almost all the cops I have come across, have that air of entitlement. As if, we are cattle and they are the royalty, and has in good graces, let us “work” there… It’s not like it’s the other way around. No wonder, why a few just loose their marbles and end up blasting these people sometimes. I just hope, when that thing happens, none of the good ones get caught in that sh!t storm!

One of the biggest problems with modern law enforcement is that hyperbolic emphasis on officer safety– which is a valid concern that auditers all too often dismiss out of hand– conflicts with the orthogonal goal of community relations. Yes, incidents like the Newhall shooting do happen, and it is important for officer training to focus on vigilance. However the pendulum has swung too far from officer friendly to soldier cop for my taste.
Every time an otherwise law abiding citizen has a negative interaction with an officer, he or she becomes that much less likely to trust and cooperate with law enforcement in the future. And that greatly harms the relationship between citizen and officer that our political and law enforcement culture is supposed to be based on.
I have to disagree with the finding of the PD. They get an F for all the reasons stated in the video, but for also failing to ensure the capture or protection of the two officers’ worn bodycamera footage. These cameras are there for the purpose of keeping an honest, unbiased record of the events, so when 50% of those responding fail to produce/protect said video evidence, it is a clear dereliction of their duty, OR a gross indication of their department, one willing to do what it takes to avoid public scrutiny. Any organization whose success record is tied directly to the collection of evidence that also has such flagrant disregard for video footage collection which may in fact exonerate their behaviour, for the simple reason that it MAY catch them acting poorly, should more than likely have the entire leadership removed, the officers retrained, and the staff sacked or transferred.
I’ve watched many Audit the Audit clips and noticed a common theme about the police interactions “…the officers missed a valuable opportunity…” Somehow during the course of doing their job; the police forgot about common decency and forgot about “to protect and serve.” This stop should have been, “wear your seat belt” followed by “have a nice day.” Instead 4 officers are involved.
It always amazes me when out of control cops tell people to relax.
How TF did you give the cops a C, after they purposely hid Incriminating evidence? There was a reason he only got 2 bodycam videos. There is always a reason… they always suppress the videos that makes cops look bad. Often it’s conversations between each other as they conspire to create a crime that didn’t exist. It is what they believe their job is.

  • “the officer made a mistake” is what people will say to defend actions like this as “not a big deal”… bad cop defenders will never find this offensive until THEY are being accused of something they had not done… the cops were SO certain they were going to find something else, they lead with a lie that had to keep evolving from smoking, to loitering… without video evidence how do you beat the testimony of a “decorated officer with extensive training and knowledge”…

  • I think the lady cop backed herself into a corner once she called for backup. After she called for backup, in order to “save face” with her coworkers looking on, she had to write a ticket for something. It remains to be seen if loitering would have been the citation until it was suggested by her fellow cop. Hope the fellow fought the ticket – especially the trespass one. These cops are wildly out of control and don’t appear to have an adequate working knowledge of the Utah “no smoking” law.

  • The problem here is the police have developed their policy around the grey areas of the law that give them authority. It is the reason there needs to be a totally separate organization.

    • I hadn’t thought of it that way but seems accurate. I think it’s also a combination of some officers that are just plain bored. She prob saw someone who looked out of place in “her” community and went on a fishing expedition cause he looked like someone who smoked and when that didn’t work she had to find something to justify her stop and jam him up for not being adequately deferential to her perceived authority. She’s prob also trying to climb the ladder and had a supervisor comment on her dearth of citations. It’s a system that rewards finding or even creating criminality rather than keeping peace. Department budgets and funding are based on amount of “crime” rather than creating a culture of mutual respect and lawfulness. They assume low crime rate means they’re not “finding” it. They need to justify their exorbitant budgets and military toys somehow. Yet if there is a spike in actual crime they have a press conference reassuring the public that it’s not really that bad because they keep the peace and exaggerate any small decrease in crime as solely due to their department. It’s a self-reinforcing cycle of judicial theater.
  • when they sited him for trespassing, i would have asked them if uta had asked them to remove me for trespassing. the police don’t have the power to just trespass you, unless the property manager has asked them to remove you, that is not in their power to do.

  • couple years ago my fiance and I watched a police officer pick up my wallet from a Dollar General Store parking lot. I was going to visit my brother who has cerebral palsy so my fiance went to the police station to have the officer dispatched. They threatened to arrest her and basically said even if they did recover it there’d be no money in it which it had 130$ in it. The officers basically intimidated her and threatened to arrest her if she filed a complaint. Realizing the weren’t going to help or be honest about the officer who picked up the wallet she decided to leave and we just took it as a loss several weeks after that every time we were in that part of town we began to be followed by patrolmen and a couple of months after that incident they followed her from one end of town to another stopping her and saying the reason for the stop is that they didn’t believe the color of the car match the color that was listed on the registration and when she proved them all of those things they cited her for having a mask hanging from the rearview mirror saying it obstructed her view. six officers showed up on that incident and I myself refused to identify myself because I had did nothing wrong apparently they didn’t like that because we have had nothing but harassment and intimidation from and on Sept 9th 2021 one of the same officers involved during original incident stopped us after we were parked in the out of our vehicle he even admitted on the report that he was several cars behind us and the reason he stopped us was because we didn’t engage your turn signal 100ft prior to the turn but tomorrow understanding that is only when traveling on the highway not within a municipal Corporation limited long story short we were ripped from our vehicle they threatened her and told her that she could go home if she provided my information which she refused they arrested her did not read her her rights tell her why she was being arrested or any of the above and during the arrest after we had already asked for a supervisor because the officer lied on the report and on the violation they’re trying to say now that the cam footage doesn’t exist and that is a lie it just shows one of the officers dropped their gun clip and bullets fell out everywhere while having my faced slammed to the ground. We tried to file a complaint with the chief of police for that incident and was threatened with arrest for making false accusations not a reporter knees has he been listen to our side of the story and trying to get us both to court to charges that we did not commit but are only trying to cover up their misconduct where do we go for help

This is a common misconception, upon full information to fill out a ticket and an officer signature there is no need for the issuant to also sign. This is classic bully tactics and retaliation because the initial ‘infraction’ was never cited nor spoken of again.

  • I got hassled in the UK by a community police officer (something below a full police officer) for pulling over on double yellow lines (no parking) to let a passenger out. He told me I couldn’t park there and I said I wasn’t parking, I was just letting someone out and then moving on. He said that’s the same thing. I asked why double red lines exist (meaning no stopping) and rather than answer, he just started walking around my vehicle looking for a different reason to give me a hard time. That’s what they do. If you bruise their egos, they will find a petty reason to punish you. Since he was not a full cop I just drove off in the middle of him doing his checks.

  • This one would be an easy inexpensive to beat. Simply ask the officer why she initiated contact. Either the truthful answer (she believed she observed him smoking) or the false answer (she observed him loitering) would be difficult for her to prove. Smoking: beyond her belief, there was no evidence; when she arrived at his location,, no cigarettes were found on his person, no extinguished cigarettes were found nearby. Loitering: he had a legitimate and lawful reason to be at the station, so no loitering.

  • This is downtown near Gateway Mall and Plaza. There’s cameras probably about every twenty or so feet. The cops had evidence this guy was smoking then they should have issued a citation ;But this is unclear if he was smoking or if there’s a violation of any kind. If you presents this in court the charges will be dismissed. Then again Sue UTA for quite a bit. UTA is partially public owed.

  • In the U.K. where I live, the cops don’t act like tyrants. If you commit a minor traffic offence, or accidentally drop a piece of litter for example, the cops would probably just give you some advice, “Be careful, don’t do it again” Part of the reason for this is that if you get charged with a minor non – criminal offence in the U.K. then the cop will have a lot of paper work to write up, which they would rather not have to do.
  • Instead of suggesting that auditors stay quiet (a virtual impossibility for many of them), you should suggest that they either stay silent, or answer every question with a question (which is both NOT answering a question, and not staying silent). I think that you will find that many of them are capable of this far easier than just remaining silent.
  • Just so everyone knows, the videos of the light rail train is NOT from Utah. That is the Hoboken, NJ light rail station. It is connected to the Hoboken NJ Transit train terminal. I know because I lived in Jersey City most of my life and have been an EMT with the Hoboken Volunteer Ambulance Corps for 22 years.
