Several police officers take it upon themselves to detain Philip Turner to force him to produce identification, even though they tell him that they know he is a first amendment auditor.  (They disparage his YouTube legal education and tell him “this isn’t working out like you expected”.

When a cop says he’s not gonna argue with you, it’s because he knows he’s violating your rights and that he’s wrong. He’ll just throw you in a cage regardless, and let you have your day in court. Take away their precious qualified immunity, and watch the magic happen.

  • Sadly, this cop has been doing this to citizens for years, totally ignorant of the law. They, however, messed with the wrong guy.

I am a 25+ year professional and degreed journalist- I don’t say that to diminish non-journalist 1A rights… no journalist has more rights than a private citizen. Conversely, no citizen has less rights than a journalist. My favorite 1A audits are the totally silent ones. A lot of “auditors” say they are going to be silent, but almost none ever remain silent. But a few have, and it was glorious. (In states that are not stop and ID.) I do know, however, that POC have to be more careful in every regard. (Lots of cameras and friends with cameras far away.)

As egregious as this whole incident was, what bugs me the most is that knowing they are in the wrong and can’t ID Mr Turner, they keep him in handcuffs for one more attempt and then lecture him. At the point they knew they were wrong, those handcuffs should have been off and Mr Turner freed without a second’s delay. Instead, it was another four minutes between the Officer Copsplain approaching the car and Mr Turner being taken from it. If I was on the jury, those 4 minutes would have cost the city a million dollars.

The cop-splaining went into overdrive after they figured out that they were way out of line. You are and have always been one of my favorite auditors due to the way you handle your business. I love how the cops always pull the “you may have a medical condition ” and we may have to have you checked out. Once those words are spoken, you have the cops scared.
“How are you expecting this to play out?” I expect you to know, follow and uphold the law, Officer. If you cannot or will not do so, I expect you to either relieve yourself of duty or be relieved.
This is what happens when you live in a society that requires the person who cuts your hair to have more of an education than the ones who are given a gun and told to uphold law and order and protect and serve the people. I wish a university would do a deep dive study into the personality types who become cops. There are plenty of good cops but we have a abundance of evidence that certain types of people go into law enforcement because they feel it gives them power over people.
That part at the end where the officer says “you can buy a copy of the report”… That’s the exact reason we need to record. They put layers of red tape and can deny FOIA requests for whatever bs reason they come up with. It’s always funny how when people want body Cam footage it takes forever to get released but if the footage clears an officer it’s out immediately.
Did I hear that correct? The settlement was $5500? If so, that is a rounding error for a department that size. They spend twice that annually on fuel for just one patrol vehicle.

The cop doesn’t know the speed on the road but he knows he was speeding 🤦🤣
He didn’t know what the speed limit was but he was sure that he was going 10% faster than what he didn’t know. Huh?
Claiming he was going 10% over the posted speed limit is pretty specific when the officer didn’t know what the posted speed limit was.
10% over the speed limit? For 2-2.5 mph over the speed limit? Wow!

Another officer, a Sgt no less, who believes he can stop anyone he wants to anytime he wants to just to check their ID!! This is crazy! Auditors are def making a difference by educating citizens about their rights, but sometimes it seems like the officers are getting WORSE!

 

The driver was not guessing his speed as the cop inferred. He had it in the screen in front of him. They can pace someone for speeding but the driver is right, they cannot gauge it from sitting still. Cop was mad because he was proven wrong and then the guy knew his rights. Egos in policing is dangerous and deadly!
“I’ll LET you go.” Mighty fine of him to let him go esp. since he committed no crime. Tyrants!
I really believe the cops are gaming the public with you must show ID even if there is no violation. That many cops can’t be that misinformed. What I think is happening is its a nation wide campaign to keep saying it until the public believes it and then slide it in there and make it an actual law.
The problem is that cops are never wrong, they don’t know how to acknowledge any mistake, infact the opposite happens when they are wrong and get called on it they usually escalate and start manufacturing a crime to justify their wrong doings… Sick….

 @Tempus Fugit  That’s a very idealistic point of view. But I’m sorry to inform you that in the real world, the citizen doesn’t often win an argument he insists in having on the side of the road. No I’m no boot licker and I’m no push over. I assure you I’ve made my displeasure and my resistance known in more than one occasion. In the case of this video, the guy lucked out that the cop was pulling the speeding charge out of his ass because he realized he was wrong about the phone and he happened to have gotten caught on the fact that he didn’t know what the speed limit was. AND the supervisor that responded happened to be a reasonable guy and want looking to just jack with a citizen. He made a half-assed attempt to claim they can just stop random drivers to check their drivers license. When it was obvious he wasn’t getting away with it, the supervisor let him go. But I assure you, had the supervisor had his ego as invested as the officer did, that driver would have either coughed up his DL or he would have been a guest of the county for a while. Right wrong or indifferent, it’s up to the cops how that encounter ends. Luckily, he argued his point and the supervisor decided it wasn’t worth it to take it all the way because his guy was wrong. But make no mistake, had he decided to back his officer, he would have been ordered out of the vehicle. Had he refused, he would have been taken out of the vehicle. Just that noncompliance could lead many judges to decide that he was resisting and obstructing by refusing a lawful order to exit. Who knows what he would decide on the citations. But, I’d be willing to bet a judge would find that it was a lawful stop initially because cops are allowed to make a mistake like thinking he was holding his phone. And from there, the officer doesn’t need any justification to ask the driver to exit the vehicle. His refusal to do so buts himself a ride to county. Is that fair? Nope. But it’s not up to you or the driver to declare it an unlawful stop or to decide when it became decided that he had made an error about the phone. His resistance in such an excessive manner could be seen by the judge as reasonable suspicion to continue investigating. It all depends on how the judge interprets his actions and the actions of the officer. But it seems like you’re if the mindset that any time a citizen believes he hadn’t committed the infraction he was stopped for that he can then lawfully defy lawful orders based on his belief that they’re unlawful due to his belief that he didn’t commit the infraction. Doesn’t work that way. If it did, everybody would just say “no I wasn’t speeding. Wasn’t me. “. And then the cop has to say “ok maybe it wasn’t you. I guess there’s nothing else I can do since you say you didn’t do it. Have a nice day”. As much as that would be awesome, it’s just not realistic and would make it impossible for cops to do anything. Bottom line, the guy rolled the dice and hit so was able to leave. He just as easily could have crapped out and had his day turn south real quick. You’re free to roll those dice too, of course. But if you think you’re going to win every time in a situation like that, you’re crazy. Not saying the cop was in the right or would have been to arrest him. He was just following policy which I guarantee states that he woulda had done explaining to do if he’d made a stop and didn’t even get the guys DL. Don’t like that policy? Fine. Petition your elected officials to try n get it changed. Aside from that, the cop is going to insist on that DL every time
If a officer wants to violate your rights he is forsure going to do so, this is why I’d say allow him to violate your rights and record it so you will have all the evidence you need because if we don’t hold them accountable then it’s only going to get worse.
My opinion is the supervisor knew this stop could go sideways and get crazy. The time and effort in making this man show id will be more problematic then its worth and this driver was committed to standing his ground. Cop was professional and explained his opinion well but needs to stop the crack addiction. ( ID ) that is.
Cops saying “I’m not gonna argue with you,” is cop speak for: I know I’m wrong, but I’m a cop and I’ll do what the fuck I want, and if you want to pursue it, I have qualified immunity so I’ll be just fine.
I would have pointed out that there was no way he would know if you were speeding if he didn’t know what the speed limit was in the first place.
The supervisor didn’t know the law either, as he said that it was legal to ask to see the drivers license, but at least he let the man drive off after having lost a much too long time for nothing due to a lying LEO not knowing the law (as usual)
Looking at this cop should communicate what’s driving him is far more than fabricating a traffic violation to check for warrants.

Cop Attempts to Ticket Motorist for Speeding without knowing Speed Limit

 

 

The cop didn’t know what the speed limit is BUT he knows he was going 10% over the limit. Amazing precision amidst ignorance.
7:45 – if I was a traffic judge, as soon as the officer said he didn’t know what the speed limit was at that point, I’d instantly dismiss the ticket and reprimand the officer. How do you know he was going 10% over, without radar, and without knowing the actual speed limit?!
Instead of just owning the mistake, he knowingly backs his officers lies with more lies, and they wonder why citizens don’t like them.
Cop admits when retelling his story, “I pulled you over BECAUSE of the phone.” Proof they hire the dumbest people they can find.
The worst part about a ticket like the one that could have been issued is that the officer wouldn’t show up to court so he wouldn’t have to be wrong. The police get paid overtime and get promotions based on tickets given, not convictions.

I’ve very seldom heard a cop or other government employee admit being wrong or offer an apology.Their egos are to big.
The whole issue here is that once a cop says something no matter how stupid, he feels like he has to stick with it. No matter how stupid, no matter how you prove he was wrong. And the supervisor has to back him up no matter how petty and trivial the matter is.
Show the cop he’s wrong, he immediately moves the goalpost. Lying is all they know.
How that didn’t escalate into being ripped out of the drivers seat I’ll never know. Well done. You stood up for exactly what you felt was right.

The cop completely lost the argument when he admitted he didn’t actually know what the speed limit was. How do you know if someone is speeding if you don’t know the limit?
If the cops are ever harassing you, just run inside the nearest school. They will never enter a school to make an arrest.
Cops needs to be fired immediately. The sergeant even was making fun then tried to fabricate an id infraction.
What a waste of resources, I’d ask him to write me that ticket for 2.5mph over the limit, just to watch the judge call him an idiot. No judge is going to uphold 2.5 mph speeding charge based on visual estimation, and they should be pissed at any police officer who thinks that is worth the courts time.
This, even the pettiness and/or small impact, is a bridge event. Take nothing, give nothing. If the cop pushed at the 10%, and demanded identification, and went ahead and wrote the ticket… seems like a slam shut case of 18 242, especially with the 30 mph signage. Unfortunately, statistics on bad arrests/ unfounded ticketing/ ect. are not provided.
First said the guy was on the phone and officer said my mistake then the officer didn’t even know what the speed limit was. This officer absolutely is pulling people over for no reason. Then lie a officer that does this is corrupt period. Should be fired.
I’ll tell you exactly why that 2nd officer let him go. Because he knew that a man driving a Ford Raptor probably has the money to fight them and sue them.
It’s the camera. They can’t seize the footage, so they know they will be caught.
He should have mentioned to the “stupervisor” that’s the cop assumed he was going over 10% of the posted speed limit, but the officer couldn’t tell him what the speed limit was.
“We can stop you to check your license.” If that’s true we are all screwed.

Ironic how the officer stated that he was driving over the speed limit, yet doesn’t know the speed limit himself. He then states with 100% certainty that he was driving 27.5 mph, and then we find out the speed limit is 30 mph.
 @Michael Dose  Arkansas is a stop and ID state on one condition and that’s loitering!! They will use that everytime to get your ID!!! You can park your car in Walmart parking lot, immediately get out and walk to the doors and they will call that loitering just to ID you!!! That is no joke!!!

I don’t know of any which allows them to arbitrarily pull people over in Texas. However, Texas is the ONLY state I’m aware of that has a law which allows officers to take ANYONE to jail on ANY traffic infraction. It is of course officer discretion but I don’t know of ANY other state with that law. If I’m wrong I would like to know.

  • Okay, hear me out. There are so many of these videos here on Youtube. Always the same exact scenario where the cop throws a fit about a guy with a camera doing absolutely nothing illegal. I’m just an old washed up dart player but I even know what you can and cannot do with a camera and I would even know, depending on what state you live in that you can’t demand ID from someone who is doing nothing wrong. So basically WTF is wrong with all these cops? Is it an ego thing? I definitely feel like the Chief is the type who feels he is above the law. “His parking lot” over and over. First of all, it’s not “his” parking lot. He doesn’t own it and works for the people. This shit pisses me off! Cops apparently need MUCH better training than they have now.

 

  • It seems like a common theme with all of these videos, the police demand and overstep and when the auditor shows their knowledge the cop doesn’t usually correct themselves. They usually always try to stick to their wrong argument. It only makes it worse for them, it makes them look like they have massive egos.

  • Wow….I’m in law enforcement and this was hard to watch. Definitely on the side of the cameraman here, who knew his stuff and carried himself with dignity. The police were terrible- ignorant and worse, likely deliberately obstructive. And yes, they absolutely were bullies. If they had just behaved like the city clerk, (professionally) probably none of us would be watching this video. Very sad….

  • I’m from Savannah, Ga 20 mins away and we don’t messed with Pooler police they are rude and have nasty behavior. Imagine not knowing the laws and how many ppl they arrested over stupid stuff.

People need to see this stuff.Its awful, people can be taken into custody here without warrants or cause and no due process and any atonney you get charges more than you can afford to get the legal help you need and they are on the same payroll if they are pro bono.   • I’ve been robbed, assaulted, publicly harassed, crashed into, threatened with guns, etc. Never once did the police catch any of the people who did these things, unless it required the absolute minimum effort because the person who crashed into me totaled their car.     • Pooler is just out side of Savannah where I lived for over 20 years and everyone knows that the Pooler police will write tickets for the most minor and insignificant infractions. For example, there was a women giving a ticket for driving while distracted because while she sat at a red light she took one hand off the steering wheel to take a bite of a sandwich.
    • So the City attorney agreed that it was proper for the Sgt. to demand ID with no RAS, that it was legal to trespass him out of the parking lot, that it was proper to restrict his access to city services because he was recording, that he was required to identify himself in a public complaint, that it was proper for the Sgt. to accept the complaint on his superior officer? Are you sure he was really an attorney or maybe he just plays one on TV? I guess he will have a second crack at these question in court. As Mr. T would say, “I pity the fool.”

  • Officers took an oath to uphold their State and Federal Constitutions, which means affirming the constitutionally protected rights of US citizens. The law-abiding citizen has no obligation to provide ID under such circumstances, it is the police who have to jump over the legal hurdles such as reasonable suspicion and probable cause to detain, ask for ID, or arrest. I developed training on this for officers as far back as 2014, even then officers did not like the idea of having limited power in such situations. Ego maybe? Unfortunately, more training and regular training are needed nationwide in this area, which would save a lot of grief, embarrassment, and tax dollars. This was an unnecessary power struggle between the officers, the Chief, and the filmer. Regardless of the filmer’s true intentions, his rights should be affirmed. The fact that the police are called, that someone doesn’t like the filmer lawfully being there, doesn’t override the filmer’s constitutional rights. Once the filmer’s lawful status is determined, they should be free to carry on, without interference.
  • I can only imagine what these small town cops do to people . That is a real bad State a Canadian woman was arrested her car towed and she was put in jail. The small town cop who didn’t know that Canadians are allowed to drive in the USA with there Canadian drivers license just like Americans are allowed to drive in Canada with there US license

  • I understand why and what you are doing and strongly believe doing so is an important audit of public employees. If you want to report on this unconstitutional behavior it is my opinion it would be much better done without the descriptive editorializing (“tyrant, Bully, making fun of someone’s name) which reduces the effectiveness of the reporting and appears childish. This audit work is important yet diminished in it’s reporting by this.
