Mayor Defends Man After Cops Oppose Recording

 

What really irritates me is when the cops always seem to “arrest” someone for doing something that was constitutionally protected, but later on lower the charges to something minor because they need to justify why they arrested the individual and they know if they keep the original charge they’re gonna get sued.

There has to be a minimum level of ego and narcissism when hiring police officers. They’re never wrong. Ever.
Imagine if the guy who is recording had grabbed the officer’s arm with just as much hostility as he did to him. I wonder if the other officer would only watch as well
Unelected is more of a reason to be able to record, not less. Elected officials can be held accountable at the ballot box. Unelected cannot.
It’s amazing how the people put in place to enforce the law have no knowledge of the law, but lawyers have to spend 6 years to know the law inside and out. I think we got something mixed up…
This audit and the eavesdropping laws are a prime example of ‘give them an inch and they will take a mile’.
The very fact that they attempted to circumvent a statute into a bypass for the first amendment merely shows the level of education regarding the constitution and their understanding of it.

Police use pretext: falsely alleging the license plate light was out

A classic example of a cop fishing. So much for the 4th amendment and the oath the officers took to uphold the Constitution. Breaching the 4th amendment, especially in such a casual manner should mean being terminated from employment for both officers. How many times have you heard a cop say,’ignorance of the law is not a defense’. It should work both ways and corrupt government officials must be held to account
by The People.

I was actually surprised that the cops agreed to his request to get out of the car and check the light; particularly since the stop did appear to be pre-textual. More often than not, cops typically will refuse such a request “for their own safety,” of course.

Most people assume cop is being honest or is just to scared to question them. Love this guy checking ,we all know cops lie and bullshit to pull people over and then hemming them up . Love he recorded too ,if everyone did these little things that this guy did cops would maybe stop this shit .

 

I get that cops make mistakes, but the minute she pulled the car over and walked up on it, she could clearly see that there was nothing wrong.

 

I’m honestly shocked she agreed to let him check knowing she was lying, did she expect her partner to stall him or something?

 

She still ran your license after you indicated to both cops that the plate lamp was fine. This is not a mistake! This is phishing and harassment to try and get you on some other crime. The stop should have ended as soon as you showed the 2nd officer that the plate lamp was fine.

 

Never surrender your 4th amendment rights until you have verified the reason for the stop. Your plate lamp trick and the air freshener hanging from the rear view mirror are the cops favourite go to excuses.

 

A mistake may happen however, as a “professional” there is a certain level of due diligence which these cops MUST succeed.
If in fact this cop authentically believed the plate light was out, she had substantial opportunity after turning around, pulling the vehicle over and walking up to the vehicle before speaking with the occupants. This may have been a mistake at first but once “negligence” entered the picture, it is no longer a mistake. It became a “breach” of these people’s rights.

 

After confirming the light was not out, the cops should have said, Sorry, provided their information and left these people alone but the female cop proceeded to run the license of the driver. This was egregious at this point. This becomes contentious and causes me to believe the female cop was deceitful from the onset and even before pulling the vehicle over. My assumptions cause me to think that the female cop literally made it up when the driver asked why she was being pulled over.

 

Notice how the officer quickly went to run the ID after plate lamp was discovered to be working. Should have ended right there.

 

This is the reason states are looking to abolish the practice of traffic stops for petty crap like this. Oregon (I could be wrong) even went so far as to end the practice of “fishing” by police. They can only ask questions that pertain directly to the reason for the stop.

 

And that, sports fans, is what we call an illegal traffic stop to conduct a fishing expedition.

Case law has clearly established and states that a traffic stop is over immediately once the reason for which they pulled you over is established as incorrect/an honest mistake unless during the stop they find something else that is illegal that they can further detain you…like a seatbelt violation or drugs in the open, etc.

 

What a “B” she knew damn well their light wasn’t out. They didn’t think the guy would get out and check it. They wanted to hem them up on something else.

This is “dragnet” style policing, and they don’t care how many people’s rights are violated in the process. This is what you get when the police are desperate to account for their massive budgets, but have not the capability to prevent crime or actually keep people safe.

 

How are you a cop if you can’t see that the light was working while driving behind them and then even worse when walking toward the car.

 

It’s a tactic they use, talk to the wife when husband not nearby, and speak in a “concerned” manner to the woman. In all the auditor vids I’ve seen with wife/gf in the situation, cops always fish more aggressively with the woman.

I got pulled over 20 years ago in Compton, California for having my front view mirror obstructed by a pair of dogs tags. Here’s the funny part… I was driving a lifted full size Ford Bronco with tinted window in the back. The cops pulled me over followed for over two miles… Explain to me, how the F$&k could they see what was hanging in my lifted truck 🤔 They couldn’t… and they just used that as an excuse to search my truck and feed off my ignorance. Give it that I was only 19 years old at the time. I now wish a Mofo would try to pull that BS now! 😡

I have had this happen a couple times , always late at night . Looking for DUI people on the road . That cop chick was lying her ass off . What is funny is apparently in her world lying is justified .

Once they saw the deputy was lying they should remain silent and not answer their questions. This was a BS stop to try and get a reason to search your car.

 

Ehh, it’s good they called them out. However the whole point was to run her license. At the time they recognized that the light was working fine it then became an illegal stop and she should have never surrendered her license. But at least she’s following up with a complaint.

 

Obviously a fishing expedition by the police. If the cops thought that her tag light was out, it would have been obvious to the cops that it was working as soon as they got out of their car and approached the vehicle. The stop should have ended there with an apology from the officer.. So then the cop started asking intrusive questions that insinuated that there might be some sort of domestic violence in progress. Very deceptive.. And the police wonder why the growing public has become increasingly negative towards the police.

 

This couple should FOIA dash cam and body cam footage of this incident. I’d give anything to hear the two officers’ conversation prior to and after the stop. This was clearly a pre-textual stop and it’s quite possible they would have discussed carrying it out prior to effecting it. And if they had any insight at all, they would know just how badly they had f***ed up, and that a complaint was incoming and they’d likely want to discuss ways to effect sme damage control. Depending on what’s there there could quite possibly be fruitful grounds for a civil rights law suit too. Kudos to the couple for putting these cops firmly in place.

Since the Floyd murder most states made things worse. Except for one state the police that violate the laws that they swore an oath to uphold are now indemnified (Held harmless.) Their employers pay the fine that in most states is capped at 2 million dollars. (The Floyd murder was 27 million.) One state has the bad cop pay a pittance while the department pays the rest. Bad cops still are not punished for violating rights. The civil rights committees (deck was stacked) were weighted heavily with retired or current judges and officers. This is how the wool was pulled over the eyes of the public when they, “Stripped Qualified Immunity.” Still there is no punishment for the bad cops. The departments get off cheaper with the money cap on awards. The victims were stripped of just compensation. Bad cops aren’t hurt, departments are hurt less, and the victim’s got the shorter end of the stick.

Nothing speaks to guilty behavior like destroying evidence —like removing entire city boundary signs.
Obviously it was the police that cut the sign. If it was municipal road maintenance, they would not have left the dangerous and sharp stubs sticking up. Sharp stubs hidden in the vegetation at the end of a sidewalk, perfect for a child to fall on and seriously hurt themselves. Even in construction sites, we put bright orange plastic ‘mushrooms’ over the ends of rebar to prevent injury. This is totally irresponsible and a huge liability issue.
If the cop was so afraid of someone “he doesn’t know” coming up to him, why did he exit his car? This cop is a coward who uses the protection of the state to act tough.
Chestnuts News called and left a message for the Chief of Police of Hamburg. Much to his surprise he actually returned his call. He said that officer Sullivan was completely out of line for
1) sitting outside Hamburg,
2) not de-escalating the situation,
3) writing retaliatory tickets against a journalist who caught him breaking the law.
He said he doesn’t know what happened to the Welcome to Hamburg sign, his investigation will include looking to see if any cameras at area businesses might have caught the sign removal, and in fact he was going there right after his phone call to go out there to see if it got dumped on the side. He said he was going to require officer Sullivan to take remedial training on de-escalation skills as well as making sure other officers are aware of the 100 foot rule (not 100 yards). He said none of his officers should be going outside the city limits unless it’s absolutely necessary. He asked what is going to happen to AEC’s retaliatory ticket and he said he was going to get with the DA to see if they can get it dismissed before court date. He said I have to say I’m really impressed with this Chief. He was open, humble, and he seemed to be honest. He said if he discovered that someone inside the department removed the sign they would be fired and charged with theft.

Cutting down the sign is misprision of evidence. Depose whatever the local equivalent of the public works department is. Someone has committed a felony. They won’t face criminal consequences, but it will cement the city’s civil liability.
A valuable LESSON to ALL AUDITORS in this video is: ALWAYS do a nice, steady, slooow, 360* pan more than once during a video (maybe zoomed in just a little depending on distances involved) of the entire area. WHY? Well in this video, such a careful, clear, slow 360* scan would have clearly cemented WHERE exactly the cop’s car was sitting and which WAY it was facing, WHERE exactly the auditor’s truck was sitting (it could have/should have been parked several feet more away from the road as THERE WAS NO SIDEWALK THERE (who else caught that right away when they headed for his truck?) and it would have clearly shown the CITY LIMIT SIGN existence and location in relation to the cop’s car, the auditor’s truck, etc. Details being recorded OFTEN DO MATTER in these audit videos, and…the camera can only see what it is pointed at and focused on during the recording of the video.

Who’s the “bad cop” here? Answer: It’s the 2 other officers on scene that did nothing to stop and deescalate the unlawful detention. They knew their fellow officer was wrong and they didn’t stop him.
He actually said “sneak up on me”. Broad daylight with a camera… That’s an admission of poor situational awareness. Acting like a tough guy but scared of every citizen interaction. Every department policy claims to be professional and courteous when interacting with the community… I have yet to see this expected behavior from the police.

This cop knew from the get-go that he was busted. I think that he felt that he could intimidate his way out of the situation, but he failed at that also. He reached into his bag of lies and came up with “Walking in the street, then it was demanding ID for illegally parked. His fellow officers should have put the choke collar on him by then, but that did not happen, so they should be named in the lawsuit as well. This poor excuse for an officer needs to be taken down a few notches and get some mandatory retraining.
He wanted his name to try to get the upper hand. It was like this, “Ok, you know I’m writing tickets outside my jurisdiction, but now you also know that I know who you are”. It was a failed attempt to make AEC think twice about making a big deal about what he found him doing.

I would love to hear a cop tell a judge they have jurisdiction outside their jurisdiction. Maybe it’s time that someone request all car dash cam and look at every ticket they write. Find a bunch of illegal tickets and watch so many others get dismissed, plus being able to ask cops if their fellow officers illegally write ticket and the officers will have to say yes

Something seems illegal when he, the cop, solicited a deal that if the citizen would give up one of his rights then he would take him ‘out of cuffs’.

That is a very good point about them issuing parking tickets all the time and they don’t need anybody’s ID to do it.
The officers that stand by and watch these retaliation actions or join in are every bit as guilty and should be disciplined
Get rid of qualify immunity with solved most of all these incidents. Cops would automatically act better if they had to pay the court fine for breaking the law

Is it possible to call there DOT to see if they cut the sign? If not then report it to the DOT and start an investigation for Vandalism, they should put the sign back up.

I have no clue why cops thinks moving/removing signs actually changes the official jurisdiction lines. My father was career law enforcement and told me about a particularly dangerous intersection on the very edge of the county. People would often crash into the county line sign. The officers hated having to respond to accidents so far out in the hills, so each time the sign got knocked down they would knowingly reinstall it on the other side of the intersection in an attempt to make the neighboring county have to respond to the next accident. Both counties would move the sign back and forth in an attempt to shirk responding to the accidents. It got to the point neither county knew their actual jurisdiction boundaries.
