The Week When President Trump Resigned

Trump resigned the presidency already — if we regard the job as one of moral stewardship, if we assume that an iota of civic concern must joust with self-regard, if we expect a president’s interest in legislation to rise above vacuous theatrics, if we consider a certain baseline of diplomatic etiquette to be part of the equation.

.. He abdicated his responsibilities so thoroughly and recklessly that it amounted to a letter of resignation. Then he whored for his Virginia winery on the way out the door.

.. Trump knew full well what he should have done, because he’d done it — grudgingly and badly — only a day earlier. But it left him feeling countermanded, corrected, submissive and weak, and those emotions just won’t do for an ego as needy and skin as thin as his.

.. All that time on Twitter wasn’t principally about a direct connection to voters. It was a way to stare at an odometer of approval and monitor, in real time, how broadly his sentiments were being liked and shared.

.. A president is supposed to safeguard the most sacred American institutions, repairing them if need be. Trump doesn’t respect them. He has sought to discredit and disempower the judiciary, the free press, the FBI, the Congressional Budget Office. He even managed to inject politics into, and pollute, the Boy Scouts. This is the course of a tyrant.

.. I kept coming across variations on the verdict that he had “failed to lead,” and that phraseology is off. “Fail” and “failure” imply that there was an effort, albeit unsuccessful.

Citing Recusal, Trump Says He Wouldn’t Have Hired Sessions

President Trump said on Wednesday that he never would have appointed Attorney General Jeff Sessions had he known Mr. Sessions would recuse himself from overseeing the Russia investigation that has dogged his presidency, calling the decision “very unfair to the president.”

In a remarkable public break with one of his earliest political supporters, Mr. Trump complained that Mr. Sessions’s decision ultimately led to the appointment of a special counsel that should not have happened. “Sessions should have never recused himself, and if he was going to recuse himself, he should have told me before he took the job and I would have picked somebody else,” Mr. Trump said.

.. In a wide-ranging interview with The New York Times, the president also accused James B. Comey, the F.B.I. director he fired in May, of trying to leverage a dossier of compromising material to keep his job. Mr. Trump criticized both the acting F.B.I. director who has been filling in since Mr. Comey’s dismissal and the deputy attorney general who recommended it. And he took on Robert S. Mueller III, the special counsel now leading the investigation into Russian meddling in last year’s election.

Mr. Trump said Mr. Mueller was running an office rife with conflicts of interest and warned investigators against delving into matters too far afield from Russia.

.. Asked if Mr. Mueller’s investigation would cross a red line if it expanded to look at his family’s finances beyond any relationship to Russia, Mr. Trump said, “I would say yes.” He would not say what he would do about it. “I think that’s a violation. Look, this is about Russia.”

.. In the interview, Mr. Trump said he believed Mr. Comey told him about the dossier to implicitly make clear he had something to hold over the president. “In my opinion, he shared it so that I would think he had it out there,” Mr. Trump said. As leverage? “Yeah, I think so,’’ Mr. Trump said. “In retrospect.”

.. Mr. Comey testified before Congress that he disclosed the details of the dossier to Mr. Trump because he thought that the media would soon be publishing details from it and that Mr. Trump had a right to know what information was out there about him.

.. Mr. Comey testified before Congress that Mr. Trump kicked the vice president, attorney general and several other senior administration officials out of the room before having the discussion with Mr. Comey.

.. “I don’t remember even talking to him about any of this stuff,” Mr. Trump said. “He said I asked people to go. Look, you look at his testimony. His testimony is loaded up with lies, O.K.?”

.. He noted that he actually interviewed Mr. Mueller to replace Mr. Comey just before his appointment as special counsel.

..  Talk about conflicts. But he was interviewing for the job. There were many other conflicts that I haven’t said, but I will at some point.”

.. The president also expressed discontent with Deputy Attorney General Rod J. Rosenstein, a former federal prosecutor from Baltimore.

.. “There are very few Republicans in Baltimore, if any,” he said of the predominantly Democratic city.

He complained that Mr. Rosenstein had in effect been on both sides when it came to Mr. Comey. The deputy attorney general recommended Mr. Comey be fired but then appointed Mr. Mueller, who may be investigating whether the dismissal was an obstruction of justice. “Well, that’s a conflict of interest,” Mr. Trump said. “Do you know how many conflicts of interests there are?”

.. As for Andrew G. McCabe, the acting F.B.I. director, the president suggested that he, too, had a conflict. Mr. McCabe’s wife, Jill McCabe, received nearly $500,000 in 2015 during a losing campaign for the Virginia Senate from a political action committee affiliated with Gov. Terry McAuliffe, who is close friends with Hillary and Bill Clinton.

.. But the president repeated that he did not know about his son’s meeting at the time and added that he did not need the Russians to provide damaging information about Mrs. Clinton.

“There wasn’t much I could say about Hillary Clinton that was worse than what I was already saying,” he said. “Unless somebody said that she shot somebody in the back, there wasn’t much I could add to my repertoire.”

Shortly after his inauguration, President George H. W. Bush counseled freshly minted White House appointees that, “It’s not really very complicated. It’s a question of knowing right from wrong, avoiding conflicts of interest, bending over backwards to see that there’s not even a perception of conflict of interest.

.. By holding themselves to the same exacting standards as the rest of the executive branch, they sent a clear message to those serving under them.

.. This tradition came to an abrupt stop with President Trump. By continuing to hold onto his businesses and effectively advertising them through frequent visits to his properties, our leader creates the appearance of profiting from the presidency. As things stand, we can’t know whether policy aims or personal financial interests motivate his decisions as president. Whatever his intentions may be, the resulting uncertainty casts a pall of doubt over governmental decision-making.

.. Every past administration actively supported O.G.E.’s work and respected it for taking stands when necessary. That White House support provided the office with the leverage it needed to fulfill its mission.

.. The Office of Government Ethics has been performing the same service it has always provided with respect to the current administration’s nominees. In fact, I have succeeded in moving President Trump’s nominees on average almost a week (six days to be exact) faster than I moved President Obama’s nominees during the last presidential transition, without compromising O.G.E.’s high standards. I am particularly proud of this accomplishment because this administration’s nominees generally hold far more complex financial interests than the last administration’s nominees, a circumstance that would normally be expected to slow O.G.E.’s work.

.. The press secretary touts one of the president’s commercial enterprises as the “winter White House,” and the State Department has publicized it around the globe.

A White House lawyer made the extraordinary assertion that “many regulations promulgated by the Office of Government Ethics (‘OGE’) do not apply to employees of the Executive Office of the President.”

Appearing to echo this view, the Office of Management and Budget challenged O.G.E.’s authority to collect routine ethics records.

Even some presidential nominees have pushed back against ethics processes with uncommon intensity.

.. the very official charged with responsibility for White House ethics, the counsel to the president. His office recently ginned up ten unsigned, undated waivers, many of which seem intended to have retroactive effect, raising the specter of a possible effort to paper over ethics violations. Worse, the counsel appears to be both issuer and recipient of two waivers.

.. Defenders of the status quo also seem unwilling to acknowledge the existence of a problem absent clear evidence of significant violations. This argument risks legitimizing an approach of bare minimum legal compliance. The existence or absence of identified violations is not the only measure of an ethics program — no program can detect every violation and those detected are often hard to prove.

.. Those systems depend on adherence to ethical norms.

.. Recent experiences have convinced me that the existing mechanism is insufficient. The Office of Government Ethics needs greater authority to obtain information from the executive branch, including the White House. The White House and agencies lacking inspectors general need investigative oversight, which should be coordinated with O.G.E.

.. Because we can no longer rely on presidents to comply voluntarily with ethical norms, we need new laws to address their conflicts of interest, their receipt of compensation for the use of their names while in office, nepotism and the release of tax forms.

.. Disclosure requirements can be refined and the revolving door tightened.

Republicans, Learn the Limits of Loyalty

They are looking at it wrong. He is Donald Trump. He is not “a Republican.” He is a wholly unusual historical figure who happened to them, and who now heads their party. They owe him an eager and open-minded willingness to work with him, to create helpful legislation, to join in debate and support him on areas of mutual conviction. They do not owe him a thing in terms of covering for his gaffes or oddnesses, mistakes or failures. They should not defend him on his tax returns unless they think he is right not to reveal them. They should not defend him on his refusal to make public the White House visitor’s logs—unless, bizarrely, they think that constitutes good public policy.

.. Make clear you want to work with Mr. Trump but won’t cover for him. If the president doesn’t like it, and lashes out, so what? He’ll tweet that you’re not attractive. Laugh and say: “That’s what my mother said. But I have great hopes we can work together to reform our tax system.
