America Is Not Yet Lost

The U.S. may yet become another Turkey or Hungary — a state that preserves the forms of democracy but has become an authoritarian regime in practice. But it won’t happen as easily or as quickly as many of us had feared.

.. never in the course of our nation’s history have we been ruled by people less trustworthy.

.. And the growing evidence that the Trump campaign colluded with Russia doesn’t seem to have induced any prominent Republicans who weren’t already anti-Trump to take a stand. Instead, we’ve seen erstwhile critics like Lindsey Graham become obsequious toadies promoting Trump properties.
.. we need to be realistic about the likely results of Robert Mueller’s investigation. The best bet is that no matter what Mueller finds, no matter how damning and no matter what Trump does — even if it involves blatant obstruction of justice — Republican majorities in Congress will back up their president and continue to sing his praises.
.. as long as Republicans control Congress, constitutional checks and balances are effectively a dead letter.
.. It’s going to be hard, because the game is definitely rigged. Remember, Trump lost the popular vote but ended up in the White House anyway, and the midterm elections will be anything but fair. Gerrymandering and the concentration of Democratic-leaning voters in urban districts have created a situation in which Democrats could win a large majority of votes yet still fail to take the House of Representatives.
.. Our democracy needs two decent parties, and at this point the G.O.P. seems to be irretrievably corrupt.

The Four Threats to Robert Mueller

The inquiry remains in great danger, facing four looming threats from Mr. Trump and his allies.

Curbing Mr. Mueller: Almost as bad as firing him, Mr. Trump could install someone at the Department of Justice to oversee Mr. Mueller’s investigation, a minder who could control (and cut) Mr. Mueller’s budget, eliminate some of his team or curtail the scope of his investigation.

Mueller seems safe as long as his current supervisor, Deputy Attorney General Rod Rosenstein, is in place

.. But the president has reportedly grumbled about Mr. Rosenstein and could replace him with a crony who would be more willing to interfere. The president might also try to force out Attorney General Jeff Sessions

.. Congress should maintain its recent practice of taking short, pro forma adjournments rather than taking a full recess, because the latter would allow the president to fire Justice Department personnel and replace them with recess appointments.

.. Smearing Mr. Mueller: The most certain and perhaps most insidious assault will be more of what we have already seen — a campaign to smear Mr. Mueller and his staff by pushing meritless attacks.

.. That was followed by the canard that Mr. Mueller had unlawfully obtained Trump transition-team emails — even though there is no legal basis for an expectation of privacy on email accounts provided by the government.

.. Democracy demands defense with analysis, opinion and the readiness for public protest (one of the co-authors, Mr. Eisen, has been involved in organizing these efforts). Peaceful force is something that Mr. Trump has made clear he understands. We must continue to deploy it, lest the president achieve by debasement what our collective efforts have thus far prevented him from doing directly: stopping Robert Mueller’s investigation.

Trump team’s meeting with Mueller’s office poised to ratchet up tensions

White House lawyers have told the president he could be exonerated as early as the beginning of the year, after previously reassuring him that he would be cleared by Thanksgiving and Christmas

.. They have stated publicly that all White House interviews are over and that Mueller’s team is no longer seeking White House documents.

.. The question that White House lawyers will pose to the special counsel’s office, according to the person: “You’ve had all these witnesses, all these records. Is there anything else you need from the White House?”

.. Another associate said that even in private, Trump is “confident, even arrogant” that he has done nothing wrong.

.. As recently as last week, Mueller’s team was still asking questions about the firing of James B. Comey as FBI director, one person said.

Fox News v. Robert Mueller

Perhaps the most inflammatory rhetoric has come from Ms. Pirro, the host of “Justice With Judge Jeanine” and a “presidential favorite,” according to The Times. “There is a cleansing needed in our F.B.I. and Department of Justice,” Ms. Pirro said Saturday, in her most unhinged rant yet. “It needs to be cleansed of individuals who should not just be fired but who need to be taken out in handcuffs.

.. Topping her list of outlaws was, of course, Mr. Mueller, who she said “can’t come up with one piece of evidence!”

.. Ms. Pirro, a former New York prosecutor and judge, didn’t allege any actual crimes, just that Mr. Mueller and his people are guilty of “attempting to destroy Trump.”

.. After Mr. Trump’s victory last year, she interviewed to be his deputy attorney general, a job that would have empowered her to fire Mr. Mueller on her own.

..  they should ask not whether any F.B.I. investigator has ever held an opinion about politics, but rather why Mr. Trump chose as his closest advisers people with a tendency to talk to Russian officials and then fail to tell the truth, again and again, about the nature of those communications. As The Times’s Bret Stephens wrote:“Fire? Maybe not. But we are dying of smoke inhalation.”

.. When the propagandists say, “Get rid of Mueller,” it’s not the truth they’re trying to protect; it’s Mr. Trump himself.

.. None of these attacks or insinuations are grounded in good faith. The anti-Mueller brigade cares not a whit about possible bias in the Justice Department or the F.B.I. It simply wants the investigation shut down out of a fear of what it might reveal. But if your man is really innocent, what’s the worry?
