Several police officers take it upon themselves to detain Philip Turner to force him to produce identification, even though they tell him that they know he is a first amendment auditor.  (They disparage his YouTube legal education and tell him “this isn’t working out like you expected”.

When a cop says he’s not gonna argue with you, it’s because he knows he’s violating your rights and that he’s wrong. He’ll just throw you in a cage regardless, and let you have your day in court. Take away their precious qualified immunity, and watch the magic happen.

  • The “1 bad apple” philosophy is probably the scariest part of this for me. As a sargent the amount of other officers he may have influenced is terrifying. When you multiply that exponentially to who those officers have influenced it seems the cancer of ignorance is going to spread far faster than the education he received here.

I am a 25+ year professional and degreed journalist- I don’t say that to diminish non-journalist 1A rights… no journalist has more rights than a private citizen. Conversely, no citizen has less rights than a journalist. My favorite 1A audits are the totally silent ones. A lot of “auditors” say they are going to be silent, but almost none ever remain silent. But a few have, and it was glorious. (In states that are not stop and ID.) I do know, however, that POC have to be more careful in every regard. (Lots of cameras and friends with cameras far away.)

As egregious as this whole incident was, what bugs me the most is that knowing they are in the wrong and can’t ID Mr Turner, they keep him in handcuffs for one more attempt and then lecture him. At the point they knew they were wrong, those handcuffs should have been off and Mr Turner freed without a second’s delay. Instead, it was another four minutes between the Officer Copsplain approaching the car and Mr Turner being taken from it. If I was on the jury, those 4 minutes would have cost the city a million dollars.

The cop-splaining went into overdrive after they figured out that they were way out of line. You are and have always been one of my favorite auditors due to the way you handle your business. Did you notice the camera guy was still in those painful handcuffs while the cop has the audacity to not only try to copspain away his illegal activities but he also stands above him, looking down at him like a parent with an unruly child, and lectures AT him for a while. Just another power trip thing. He knows that person wouldn’t stand around and listen to such BS. The cop stepped in it and he was trying to wipe his shoes on the guys t-shirt.
I love how the cops always pull the “you may have a medical condition ” and we may have to have you checked out. Once those words are spoken, you have the cops scared.
“How are you expecting this to play out?” I expect you to know, follow and uphold the law, Officer. If you cannot or will not do so, I expect you to either relieve yourself of duty or be relieved.
This is what happens when you live in a society that requires the person who cuts your hair to have more of an education than the ones who are given a gun and told to uphold law and order and protect and serve the people. I wish a university would do a deep dive study into the personality types who become cops. There are plenty of good cops but we have a abundance of evidence that certain types of people go into law enforcement because they feel it gives them power over people.
That part at the end where the officer says “you can buy a copy of the report”… That’s the exact reason we need to record. They put layers of red tape and can deny FOIA requests for whatever bs reason they come up with. It’s always funny how when people want body Cam footage it takes forever to get released but if the footage clears an officer it’s out immediately.
Did I hear that correct? The settlement was $5500? If so, that is a rounding error for a department that size. They spend twice that annually on fuel for just one patrol vehicle.

Very Polite Auditor Dismisses Multiple Officers

 

“You know what, I made a mistake and you are right you can be here” said no cop ever. And they wonder why there is a disconnect.

 

She is 100% correct. The actual “checkpoint “ begins where an I.D. must be presented. Everything else is either a queue or an exit aisle-way. Those airport police just walking past without so much as a glance in her direction, let alone an apology, is proof positive of their immature egos.

 

It is so baffling to these types when people don’t comply with whatever they say. They truly think that if they say something, anything, everything, it must be met with compliance or you are just being difficult.
He “literally” was pulling stuff out of his A. “Those are cautionary signs.” WTF is that?
The second cop didn’t even speak to her. He just beckoned her to follow like she was a puppy. Both cops just stalked off without mentioning she was right, it was ok to do what she was doing. I admire her for keeping her cool while standing her ground.
It’s the “bully” playbook 101. They are so used to just telling people what to do and people blindly following their directives….that they blow a fuse when someone stands up to them….they just keep repeating themselves. That’s why people like this woman are often deemed “difficult” or “a problem”….They HATE the fact that some people actually realize most of what comes out of their mouths is fabricated.
Authority when lawfully and effectively challenged will take one of two directions One is very confused and walks away and Two become violent and force their will upon the person questioning their false authority.
“You are arguing semantics.” This is a complete miss use of the word. Semantics is the study of meaning, more specifically it is the study of how LANGUAGE gives proper meaning. So when an officer says, “you are arguing semantics” the reply might be “are you saying, the law doesn’t MEAN what it says.”
This is a perfect example of “Too many people, with nothing to do”!! A woman with a camera should not even be a problem.. They definitely need to cut about half of those jobs!!! I wonder if it’s tax funded!? Anyone know if they are private or publicly funded?

“That’s semantics…” How to demonstrate that you’re an idiot. She’s absolutely correct, in that semantics is important, because it deals with what we mean when we say a thing. An enormous amount of any work in philosophy and science is centred on defining terms. The only time it’s proper to dismiss an argument as semantic is when the argument centres around disagreement in what a word means. Once you’ve defined your terms, you get on to the interesting stuff. The proper semantic content of any discussion is to provide clarity.
Where the “checkpoint starts” is very similar to the 100 mile radius Customs has from the US border which basically covers 90% of the entire US population. Its ridiculous.

I’m a TSA employee and she is correct. The TSA does allow people to take photos of the security checkpoint as long as they don’t interfere with the process. She’s In a publicly accessible area on the public side of the airport. As long as she’s not impeding people from leaving or trying to walk up the exit lane into a secure area without going through screening shes fine. I’ve counseled officers at my airport for confronting people about filming. We have a line marked where people are free to film as long as they dont go past that line and set the alarms off she’s fine. We have people filming quite often. Edit… The airport police officer is wrong. The screening process doesn’t start until you present yourself for screening. Handing your ID to the ticket checker.
I always wonder at what point do they realize “the shit aint happening”. Every officer is different in how they present their failure to perform the discharge of their duties(the majority of LEOs do this on a daily basis), so its interesting to see if they’re actually ignorant of the law, or they just think citizens are and they can get away with bullying people with lies and intimidation. I personally like to take an aggressive approach from the jump, because it tends to let the beta males masquerading as alphas know that their tactics are not going to work with me and their best bet is just to keep it moving. That way we can skip the 10 to 15 minutes of pointless dialogue where they try to convince me of their lies, and we can get right to them moving the fuck on or escalating and attempting to violate my rights.
Overstepping their authority, and they’re so used to nobody ever pushing back. Those days are quickly ending, every day more people are the victims of this type of abuse.
I love how it’s all directives and in her space until they get set straight and they can’t even look at her as they walk past..
There is a sign that indicates where the screening area is and a CLEARLY distinct transition between different types of flooring beginning exactly where the screening area is indicated to begin… Officer, just look down.
It’s funny how they never admit that they were wrong, just leave or walk away and try not to make eye contact or acknowledge the person at all.
How can you simultaneously be in the screening process AND being in the exit aisle? As far as I’m aware, the people exiting are not in the screening process.
Why won’t they just state the law if they thought she was breaking the law ?
It’s obviously apparent that the security checkpoint area would begin where the carpet ends. Airport police are notorious for overstepping their authority in the guise of national security.

 

Officers Sued For Warrantless Search

“I don’t know what you did to my officer for him to physically abuse you while your hands were tied behind your back”. What a sociopath.
ANY cop that gets a complaint against them should be heard in court in front of a jury of people they took an oath to protect and serve. NOT just investigated by other BAD cops.
This is one of the few videos that genuinely makes me angry. That cop was deliberately contemptuous toward that woman. They held the husband hostage to coerce her cooperation after injuring him. He knew full well he was violating her rights and her privacy. And what’s he gained? The loss of trust and cooperation of two innocent people.
Cops tried to get into my house once saying they received a 911 call from my house. I told them that nobody in my house called 911, but they were very forceful. After a back and forth for 10 minutes and much anger I told them I was going to sue them if they didn’t leave my property as I’m sure phone records would prove my daughter had been on the phone for over an hour, and there was no possible way that a 911 call had come from my phone, which she verified to them as she was actually still on the phone during the whole incident describing it to her friend. Finally they left. I told them not to come back without a warrant.
I ended up reporting them to the States Attorney General and both of them were fired. They had no call from dispatch sending them to my house to begin with. It turned out that they were just angry with me personally for a post I had made on facebook insulting the local police for being bullies…..they proved my point in spades.
The C- grade is very generous given the fact they did a warrant-less search based on an anonymous call.
It was a very good thing that she said “this is against my will” after she said one could come in. This is a textbook example of duress defense. Which this video went on to prove.
I love when the cops say “it’s on our video camera too” knowing damn well they wrong 😂
How can a police department settle a claim “confidentially” or for an undisclosed amount? Does not FOIA come into play since they are public?

I’m pretty sure having the husband in handcuffs untill they let the cops search the house is a reason for her to claim she let them in under duress.
 @Broken TomBot  I agree. The cops knew what they were doing. Most woman would give into police if they take her husband and make her think he will be arrested. And throw him to the ground for walking. The guy had every right to file a lawsuit.He wasn’t doing anything wrong. Just not allowing cops into his home. He didn’t need to be thrown to the ground for walking on his own property either. He never should of stepped outside. There was no reason for it. Man I’d be so mad if it was me in this situation.
The simple answer is they are using duress simply with the threat of consequences for refusal. She was clear. You have no permission, but I can’t stop you. No sane person can call that permission.

As soon as you let them in they just do whatever they want and you can’t stop them just like this cop did even though he lied and said he would only check the bedroom. And once the cop is in they don’t just leave when you ask them to. They will stay as long as they want and do whatever they want and act like they just did some great service for you.
If they were truly concerned about the medical health of someone, why would they not bring EMT? Because they knew there was no medical emergency, if there was a medical issue the It would have been the paramedics knocking on the door, if it was a medical emergency at the least there would have been a medic and then maybe cops also. They totally deserve that ‘undisclosed settlement’ money.
Until cops like that have to fear armed men forcing their way into their homes, this will never change.
It doesn’t matter how nicely you ask someone to violate them, it’s still violating them and they knew their rights.
Sounds like someone doesn’t like their daughter dating their son and gave the impending “medical emergency” as a way to claim exigent circumstances to skip a search warrant.
Does her “medical emergency” constitute ‘exigent circumstances’? If she’s a grown-up travelling with the guy on her own freewill, that should not be grounds for them to just claim to absolutely need to go into whoever’s house they fancy.
The fact that no EMS came along or was supposed to reach any time soon proves that the police did not genuinely believe that entry was necessary to prevent physical harm to the lady on the grounds of some alleged medical emergency.

I love how the cop repeatedly lies about the extent of the search. “Trust me, I just need to look in his room. That’s it. Just his room. Oh wait… I mean I need to see that room too. And that room. And that room. AND that room. Oh look, that just happened be the entire house.”
It’s pretty much 100% legal for cops to lie, (and they generally get away with it anyhow even when it isn’t) but what pisses me off is how they clearly don’t see ANYTHING wrong with it. They do it so casually, as if lying to a citizen’s face is no different than talking about the weather.

They always use the same phrase “we’re past that point” when they know that POINT is where they are wrong and they won’t be able to continue, they say “we’re past that point” as a way of saying “we have fast forwarded past your rights

The police lied about the search, “we just want to see where he sleeps”, and went beyond that. Had no business handcuffing the home owner, and copsplaining their abused. Cops get an F, home owners get an A for what they were out through.

I never knew that a man in handcuffs was such a grave threat to officer safety. Why did they handcuff the man to begin with?
