Several police officers take it upon themselves to detain Philip Turner to force him to produce identification, even though they tell him that they know he is a first amendment auditor.  (They disparage his YouTube legal education and tell him “this isn’t working out like you expected”.

When a cop says he’s not gonna argue with you, it’s because he knows he’s violating your rights and that he’s wrong. He’ll just throw you in a cage regardless, and let you have your day in court. Take away their precious qualified immunity, and watch the magic happen.

• Sadly, this cop has been doing this to citizens for years, totally ignorant of the law. They, however, messed with the wrong guy.

• I love it when an arrogant tyrant is SO sure of himself he openly mocks someone who knows the law and his mouth walks himself right off the cliff. His frequent comments about YouTube and his “I know this isn’t working out like you expected” comment is just icing on the cake. I’m having a very hard time not jumping to the original video… so I hope Part 3 is out soon! 😂😉👍

• Wow this officer’s ignorance of the law is embarrassing and his arrogance is shameful! This video will follow him for the rest of his career.

• I can’t imagine how many lives this cop has ruined and I hope he is no longer in a position of authority and no longer has the ability to interact with anyone.

• The “1 bad apple” philosophy is probably the scariest part of this for me. As a sargent the amount of other officers he may have influenced is terrifying. When you multiply that exponentially to who those officers have influenced it seems the cancer of ignorance is going to spread far faster than the education he received here.

• “Investigatively Detained?” In other words, we have no lawful reason so we’re trying to find one. 🤷

• One of the things I love about Batman is , he is a bonafide auditor. A real auditor is never afraid of being arrested when he or she knows the law is on his/her side. Stand your ground and get paid later. What baffles me is the prosecutors who actually agree to prosecute cases like these. If a prosecutor is stupid enough to accept a case like this, he or she should be disbarred.

• I’ve learn so much watching these videos. I’m baffled as to why there are so many audit videos showing Officers who clearly has no knowledge of the law, violating the rights of citizens and yet there has been no changes to Law Enforcement at all. There are some good cops but 95% of them are nothing more than ignorant bullies with a badge and gun.

• Good grief, the condescending attitude is just DRIPPING off of this cop. He couldn’t be any more arrogant and aloof if he tried.

• The “pat down” in itself is a violation of the fourth amendment. They had no ras of a crime, no ras of a weapon and no ras that you are dangerous. Therefore no lawful terry stop or terry frisk. Both are four amendment violations and the in pocket search was the third violation.

• They are so intoxicated with their opportunity to use force, they imagine their interpretation of law is absolute.

• I’m sure they were thinking they will record with your camera, for you, to show off that they are not kicking the crap out of you, like they normally do.

• I’m uncomfortable with how he’s feeling you up. Why he keep touching your junk again and again

1:25, If he wont do it willingly handcuff him.

2:28, If he has an ID we have every right to look at it.

3:59, Go ahead and put him in handcuffs and we can do it (detain him) until we find him on the system.

5:50, Hook him up. (that sounds like an arrested to me)

8:44, Have him sit in the back of the car and lets go ahead an figure out who he is. Handcuffed and buckled up in a police cruiser, a reasonable person would believe they are under arrest not simply detained. But they did put you in the front seat so maybe a little gray area.

• So voluntarily give up a right or forcefully have it violated… Ah thats how freedom works

• If they repeatedly bring up the YouTube videos and see what the outcomes are. It shows they are unwilling to educate themselves and need to be removed from the position.

• As kids we had terms for people who cried about every little thing. We called them piss ant crybabies. The majority of these cops are just trying to protect our community. If you stop messing with them maybe you will have time to invent a robot that wont make mistakes. But until then, having human cops is as good as it gets.

• I have never been a proponent of defunding the police. I am still not one. However I am for abolishing qualified immunity for any officer that violates the freedom of a law abiding citizen. If this is protecting and serving then we need to let those officers go because who can point out the good officers in this situation? For those who say just comply with unlawful, unconstitutional orders. You are a part of the problem. Law enforcement work for the citizens they are not nor should they ever be considered overlords. When that happens, we no longer have a free society. We then are worse than Hitler or Mao.

• They need a crime to detain you and for a Terry stop. A Terry stop is a frisk, not a search.

I am a 25+ year professional and degreed journalist- I don’t say that to diminish non-journalist 1A rights… no journalist has more rights than a private citizen. Conversely, no citizen has less rights than a journalist. My favorite 1A audits are the totally silent ones. A lot of “auditors” say they are going to be silent, but almost none ever remain silent. But a few have, and it was glorious. (In states that are not stop and ID.) I do know, however, that POC have to be more careful in every regard. (Lots of cameras and friends with cameras far away.)

• 6:28 “Texas is not a stop and ID state.” The cop then says “OK, Thanks for telling me the law. Let me tell you whats going to happen. we’re going to detain you until we have properly identified you”. He’s basically said that he’s going to ignore the law and carry on regardless. He definitely thinks he’s a sovereign citizen who can make up his own laws.

• COP – “The code of criminal procedure gives us that authority”.
• Supreme Court – No it doesn’t.

• cop -“this isn’t going to go according to your you tube education…..you are detained so if he has ID we have every right to look at it…..when you are stopped by a police officer you are required to give your name and DOB……..this is an investigative detention……if you want to leave and be free to go just give us your name and DOB……” = we have no idea of the law so we like to bark orders demand ID and go into your pockets to search you for no crime………..this supervisor is totally clueless.. i feel bad for the rookie officers learning from this clown….. we just want to ID you and see if you have warrants….. cops just can’t help their ego…….sadly the cop was too lazy to look up penal code 38.02

You can hear the disappointment in the cop voice, he probably just learned that he really can’t arrest you 🤣

As egregious as this whole incident was, what bugs me the most is that knowing they are in the wrong and can’t ID Mr Turner, they keep him in handcuffs for one more attempt and then lecture him. At the point they knew they were wrong, those handcuffs should have been off and Mr Turner freed without a second’s delay. Instead, it was another four minutes between the Officer Copsplain approaching the car and Mr Turner being taken from it. If I was on the jury, those 4 minutes would have cost the city a million dollars.

Arrogant, stupid, bullying, cowardly. – Someone tell me again about all the ‘good cops’ there are. Not one of those pigs intervened to say that this was wrong. Not one. Fkng disgusting.

“Cuffs are on by policy”. Isn’t it policy to only put them on law breakers?

I feel your pain on the cuffs, my wrist were jacked for a couple months after. I would randomly be cutting my food and drop my fork or knife at times. Thanks for standing up for your rights and ours!

The cop-splaining went into overdrive after they figured out that they were way out of line. You are and have always been one of my favorite auditors due to the way you handle your business. All of those screaming and obvious baiting guys have become tiresome. I do enjoy the way you handle cops and your explanations of the circumstances to us. Thanks for all thast you do Phillip!

Did you know that saying “suspicious” three times in the same statement makes it more legitimate? NO! That boss sure seemed to think so. Lol

Did you notice the camera guy was still in those painful handcuffs while the cop has the audacity to not only try to copspain away his illegal activities but he also stands above him, looking down at him like a parent with an unruly child, and lectures AT him for a while. Just another power trip thing. He knows that person wouldn’t stand around and listen to such BS. The cop stepped in it and he was trying to wipe his shoes on the guys t-shirt.

I love how the cops always pull the “you may have a medical condition ” and we may have to have you checked out. Once those words are spoken, you have the cops scared.

“How are you expecting this to play out?” I expect you to know, follow and uphold the law, Officer. If you cannot or will not do so, I expect you to either relieve yourself of duty or be relieved.

This is what happens when you live in a society that requires the person who cuts your hair to have more of an education than the ones who are given a gun and told to uphold law and order and protect and serve the people. I wish a university would do a deep dive study into the personality types who become cops. There are plenty of good cops but we have a abundance of evidence that certain types of people go into law enforcement because they feel it gives them power over people.

That part at the end where the officer says “you can buy a copy of the report”… That’s the exact reason we need to record. They put layers of red tape and can deny FOIA requests for whatever bs reason they come up with. It’s always funny how when people want body Cam footage it takes forever to get released but if the footage clears an officer it’s out immediately.

Did I hear that correct? The settlement was $5500? If so, that is a rounding error for a department that size. They spend twice that annually on fuel for just one patrol vehicle.
