Trump’s reliance on pressure tactics is showing diminishing returns

President Trump’s brinkmanship with Mexico over immigration has opened a new and risky front in his global campaign to pressure other nations to capitulate to his demands, a strategy that has paid few dividends over 2½ years and left his major foreign policy initiatives in doubt.

From his “fire and fury” rhetoric against a nuclear-armed North Korea to an escalating trade war with China to new ultimatums aimed at Mexico, Trump has wielded threats, insults and punishments against his foreign counterparts with diminishing returns.

Though he lured Kim Jong Un to the negotiating table through a “maximum pressure” campaign of economic sanctions, Trump’s historic summits with the young dictator ended in failure after talks collapsed in February.

From his “fire and fury” rhetoric against a nuclear-armed North Korea to an escalating trade war with China to new ultimatums aimed at Mexico, Trump has wielded threats, insults and punishments against his foreign counterparts with diminishing returns.

Though he lured Kim Jong Un to the negotiating table through a “maximum pressure” campaign of economic sanctions, Trump’s historic summits with the young dictator ended in failure after talks collapsed in February.

And although Mexico took steps to comply with Trump’s hard-line immigration policies — allowing Central American asylum seekers to the United States a temporary haven — Trump’s vow this week to impose sweeping tariffs unless that nation curbs unauthorized immigration into the United States stirred a public backlash.

For Trump, who campaigned on achieving “peace through strength,” the consistent application of a tool kit of toughness has limited his options and left him in a precarious position as he accelerates his campaign for a second term.

Despite his pressure tactics, unauthorized immigration at the U.S.-Mexican border is at a 12-year peak, the tariff wars have sent jitters through Wall Street, and Pyongyang has resumed testing of short-range missiles, a sign that Kim is growing impatient.

“It strikes me that we are in the middle of an unprecedented and multifaceted experiment in the application of brute force,” said Daniel Russel, who served as an assistant secretary of state on Asian affairs in the Obama administration. “President Trump has been extraordinarily effective at generating leverage . . . but it has yet to be shown that he has the ability to translate that leverage into results that are advantageous to the United States or are durable.”

Trump campaigned on the theme that the rest of the world was taking advantage of the United States because of weak political leaders who valued multilateral partnerships over the unapologetic pursuit of national self-interest. He pledged that, as president, he would not hesitate to pressure rivals and allies alike to win a better deal for Americans.

“Mexico must take back their country from the drug lords and cartels,” Trump tweeted Friday. “The Tariff is about stopping drugs as well as illegals!”

Foreign leaders initially sought to placate him by offering modest concessions, hopeful that it would satisfy Trump’s domestic political imperatives by allowing him to trumpet small victories.

The Trump administration renegotiated a bilateral trade deal with South Korea and, after ripping up the 25-year old North American Free Trade Agreement, crafted a new accord with Mexico and Canada that experts said included valuable modernizations of some trade rules.

In Europe, some NATO members moved to accelerate previous pledges to increase their own national defense budgets amid Trump’s complaints that they were freeloading off the United States’ security umbrella — and his vague threats, first issued during his 2016 campaign, that he would pull out the United States of the alliance.

But on his signature initiatives, Trump’s go-to tactics have faltered and the president has grown increasingly frustrated, prompting him in recent weeks to escalate his threats and punitive actions.

In early May, for example, after U.S. negotiators accused Beijing of attempting to backtrack on agreements after months of trade talks, Trump responded by raising tariffs on $200 billion of Chinese goods that he enacted last year from 10 percent to 25 percent.

That prompted Beijing to announce it would “fight to the end” and raise duties on $60 billion of American goods on June 1.

Trump administration officials have said the president feels emboldened by the strength of the U.S. economy and believes he can outlast his rivals in a showdown that could harm both economies. But some analysts said that the president could be dangerously miscalculating his position given the uncertainty of his own political prospects.

“I know that Trump considers the 2020 campaign as a triumphant march to the inevitable [reelection], but that’s not the way the rest of the world is looking at it,” said Christopher R. Hill, who served as a U.S. ambassador under the four presidents who preceded Trump. “You’re already seeing the Chinese holding back and saying, ‘We’ll see what will happen over the next 18 months to see if he’s still around and then maybe we’ll do something.’ To some extent, Trump does not have the self-awareness to understand that people are looking at the window closing on him.”

For Mexican President Andrés Manuel López Obrador, a liberal who took office in December, Trump’s threats are a serious concern, given that 80 percent of Mexico’s exports enter the U.S. market. But López Obrador, who dispatched diplomats to visit Washington on Friday, is facing increasing calls from the public and political columnists to take a tougher line with the White House.

Trump, frustrated by Mexico’s refusal to pay for a border wall, flirted with a plan to seal the southern border to trade and tourism in April before backing off over concerns from advisers about the effect on the American economy. This week, however, amid reports that U.S. authorities apprehended nearly 120,000 unauthorized immigrants at the border last month, Trump overrode similar warnings from aides.

What’s so striking with him is his willingness to pick multiple fights without thinking through the consequences,” said Eliot Cohen, a former State Department adviser in the George W. Bush administration who organized a “Never Trump” coalition of foreign policy experts during the 2016 campaign. “The Mexico thing is a great example. It could really hurt him domestically.”

Other analysts noted that Trump’s trade war with China could harm his efforts to negotiate a nuclear weapons disarmament pact with North Korea, given that the president has counted on Beijing maintaining tough economic sanctions on Pyongyang.

But Trump has shown few signs of second-guessing himself. He has threatened new auto tariffs on Japan to win leverage in ongoing trade talks, although he announced during a state visit to Tokyo last week that he would delay any action for six months.

And Trump’s reputation for hostility has preceded him. In London, where Trump will arrive next week on a state visit to meet Queen Elizabeth, Sky News broadcast a promotional video featuring a Trump baby balloon, flown by protesters during Trump’s visit last summer, darkening the skies with the ominous tag­line, “He’s back.”

“One of Trump’s major failings is that he only has a hammer,” said Andrea Schneider, a professor of law at Marquette University who focuses on negotiations and has studied Trump’s tactics. “He has no capacity of looking at the long term and recognizing that the vast majority of our interactions in life are repeat interactions. I joke with my students that if you treat negotiations as a one-shot deal, it will be. No one will ever want to deal with you again.”

The Cohen Searches and Trump’s De Mini-Mess

The Stormy Daniels scandal could be more perilous for Trump than the Russia investigation has been.

.. Barack Obama’s 2008 presidential campaign was caught hiding the sources of 1,300 large campaign donations, aggregating to nearly $2 million. The campaign also accepted more than $1.3 million in unlawful donations from contributors who had already given the legal maximum.

.. Under federal law, such campaign-finance violations, if they aggregate to just $25,000 in a calendar year, may be treated as felonies punishable by up to five years’ imprisonment — with offenses involving smaller dollar amounts punishable by incarceration for a year or more

.. Cohen’s law practice, which is the focus of the investigation involving the payment to Daniels (whose real name is Stephanie Clifford), is in the SDNY.

.. The SDNY is no longer run by Preet Bharara, whom Trump dismissed along with other Obama appointees after taking office. The acting U.S. attorney is Geoffrey Berman, a Trump appointee named by Attorney General Jeff Sessions to serve on an interim basis while awaiting confirmation.

.. ABC News reports that Berman is recused from the Cohen investigation

..  Cohen’s obvious relevance to Mueller’s investigation — he is accused in the Steele dossier of being a liaison between the Trump campaign and Russia (an apparently uncorroborated claim that Cohen convincingly denies); and he was on the receiving end of emails from Felix Sater, a Russian immigrant and Trump business associate, who boasted that his friend Vladimir Putin would help “get Donald elected.”

.. When one reads the guidelines, one suspects that there must be more to the SDNY’s investigation of Cohen than the Stormy Daniels transaction — a suspicion echoed in the aforementioned Times report, which describes the searches as “related to several topics, including a payment to a pornographic film actress” (emphasis added).

.. If the only matter under investigation were a potential campaign-finance violation that would normally not be grist for criminal prosecution, it would be outrageous to raid a lawyer’s office — especially the president’s lawyer.

Not only must high-level Justice Department approval be obtained before seeking a search warrant for an attorney’s premises; the prosecutors and their superiors must explore whether less intrusive investigative alternatives — such as seeking the desired materials by grand-jury subpoena — would be viable.

.. The issuance of search warrants necessarily means a federal judge found probable cause that evidence of at least one crime would be uncovered in Cohen’s premises. In addition to the potential campaign-finance offense, the feds are reportedly weighing bank-fraud charges — possibly on a theory that steps taken to hide the nature and purpose of the payment to Clifford entailed misrepresentations to a financial institution, although that is just speculation at this point.

.. The clean team determines what files are relevant to the matter under investigation, with any irrelevant files returned to the attorney.

.. the attorney and any affected clients are given an opportunity to claim that the files contain privileged communications and should be returned. Where the parties cannot agree, such privilege claims are decided by a judge.

.. the clean team ensures that the investigation team is not tainted by exposure to privileged communications.

.. As I explained last November, when we learned that Mueller had forced an attorney who had represented Manafort to testify against him, there is a so-called crime-fraud exception to the attorney–client privilege.

.. If a client’s communications with a lawyer are for the purpose of carrying out a fraudulent scheme, they lose any claim to confidentiality. Theoretically, then, Trump and Cohen have a legal as well as a factual problem. Legally, if they conspired to execute a payment in violation of campaign laws in order to silence Clifford, their communications in this regard would not be privileged.

Factually (if implausibly), both Cohen and Trump claim that the former did not tell the latter about the payment to Clifford; and that Cohen made the payment in his personal capacity, not as Trump’s lawyer. How, then, can they now claim attorney–client privilege in connection with the transaction?

.. the porn-star payment undeniably happened. I argued then, and I’m even more convinced now, that “the best argument in Trump’s favor is one that claims mitigation, not innocence.”

.. As for Trump’s fitness for the presidency, the scandal tells us exactly nothing that we didn’t already know about the flawed man that Americans chose to elect.

.. It wasn’t until he received his first formal diagnosis—initially for ADHD, rather than autism—that I realized his brain was just wired differently from mine. I was able to recognize how often I was asking him to do something he couldn’t do, rather than something he wouldn’t do. Even more important, I started to see the connection between his wiring and his talents, like his mathematical ability and his extraordinary vocabulary.

.. Once I recognized those distinctions as a mom, I started seeing them in my professional relationships, too.

.. After my son’s diagnosis, I started to pay attention to how different members of the team did or didn’t participate in our regular sit-downs.

For instance, my own wiring pushes me to jump in, get as many of my ideas on the table as possible, and then push toward a decision. But one smart young man, who was absolutely brimming with ideas, wasn’t apt to speak during meetings. He once explained to me, “I need time to reflect before I’m ready to share my ideas.”

.. After that, I started breaking our meetings into two parts: part one to lay out our goals and any relevant background, plus invite ideas from people whose wiring was set up to present ideas the way I did. In part two, I’d invite input from those who needed time. Our meetings became much tighter and more effective, and we started to tap into the wisdom of our whole team.

.. Then there were those people—kinetic learners—who I realized aren’t built to sit still. To think or learn to their full ability, they need to move around, such as pacing or jiggling their knee or leaving the office at lunch to do a thousand-calorie workout.

.. But with my new mind-set, I started to schedule walking meetings whenever I was huddling one-on-one and didn’t need to take a lot of notes; I used voice dictation on my phone to capture key takeaways as we walked.

.. Getting outside and moving around not only helped my kinetic colleagues think more clearly and creatively, but also helped me discover that moving around gets me thinking differently, too.

.. It never dawned on me that many people’s wiring isn’t set up to read throat clearing or glances at a phone as signs that it’s time to wrap up a chat, so they need more direct signals. But now if I find someone isn’t picking up on my cues, I say explicitly, for instance, “I need to end our conversation now so that I can get back to work.”

.. I have always been someone who remembers ideas and theories more than facts and anecdotes, but I had never thought about how that affects my professional relationships. I just noticed that I often had to repeat an idea three or four times before my colleagues finally understood or retained it. “Why can’t they understand the idea of aggregating and tagging social-media content?” I might fret.

.. Once I started peppering my conversations with specific, concrete examples for each of my abstract ideas, I found my colleagues were much faster to embrace my ideas on everything from software projects to marketing campaigns.

Soon, it took fewer repetitions for me to get my ideas across—but I also became more patient with the repetition, because I realized that I wasn’t speaking their language.

.. I have long realized that I have challenges with what psychologists call “executive function”—namely, the ability to break a project apart into component tasks and organize those tasks so that they can be completed on time. I’m the kind of person who has a messy desk and can easily miss deadlines, so I’ve gradually built up a set of digital tools and habits that mostly compensate for my state of mental disorganization.

.. When I start working with someone new, I let them know that I am not great at keeping track of tasks and details, so I invite them to remind me if anything slips.
