“Hate speech” is extraordinarily vague and subjective. Libel and slander are not... Most appallingly, he has insisted that these grieving families were faking their pain: “I’ve looked at it and undoubtedly there’s a cover-up, there’s actors, they’re manipulating, they’ve been caught lying and they were preplanning before it and rolled out with it.”.. Rather than applying objective standards that resonate with American law and American traditions of respect for free speech and the marketplace of ideas, the companies applied subjective standards that are subject to considerable abuse. Apple said it “does not tolerate hate speech.” Facebook accused Mr. Jones of violating policies against “glorifying violence” or using “dehumanizing language to describe people who are transgender, Muslims and immigrants.” YouTube accused Mr. Jones of violating policies against “hate speech and harassment.”.. In the name of stopping hate speech, university mobs have turned their ire not just against alt-right figures like Milo Yiannopoulos and Richard Spencer, but also against the most mainstream of conservative voices, like Ben Shapiro and Heather Mac Donald.Dissenting progressives aren’t spared, either. Just ask Evergreen State College’s Bret Weinstein, who was hounded out of a job after refusing to participate in a “day of absence” protest in which white students and faculty members were supposed to leave campus for the day to give students and faculty members of color exclusive access to the college... The far better option would be to prohibit libel or slander on their platforms... Unlike “hate speech,” libel and slander have legal meanings. There is a long history of using libel and slander laws to protect especially private figures from false claims. It’s properly more difficult to use those laws to punish allegations directed at public figures, but even then there are limits on intentionally false factual claims.
What made it extraordinary was the way the Times covered it.
.. Traditionally, when a political candidate assembles facts so as to aggrandize himself and belittle his opponent, “objective” journalists like those at the Times respond with a “he said, she said” story.
.. “Bush and Cheney Talk Strongly of Qaeda Links With Hussein,” noted a Timesheadline on June 18, 2004. Why were Bush and Cheney raising the subject? Because the day before, the 9/11 Commission had reported that Saddam Hussein and Al Qaeda did not have a “collaborative relationship.” Nonetheless, the Times reported Bush’s claims and Kerry’s response as equally valid. Bush himself had helped create the Commission to provide an authoritative, nonpartisan account of the events leading up to 9/11. Yet the Times refused to grant its view any more weight than Bush’s own. It refused to render any judgment about what was true.
.. But the Times, once a champion practitioner of the “he said, she said” campaign story, discarded it with astonishing bluntness. The Times responded to Trump’s press conference by running a “News Analysis,” a genre that gives reporters more freedom to explain a story’s significance.
.. Its headline read, “Trump Gives Up a Lie But Refuses to Repent.” Not “falsehood,” which leaves open the possibility that Trump was merely mistaken, but “lie,” which suggests, accurately, that Trump had every reason to know that what he was saying about Obama’s citizenship was false.
.. A certain etiquette has long governed the relationship between presidential candidates and the elite media. Candidates stretch the truth, but try not to be too blatant about it. Candidates appeal to bigotry, but subtly. In turn, journalists respond with a delicacy of their own. They quote partisans rather than saying things in their own words. They use euphemisms like “polarizing” and “incendiary,” instead of “racist” and “demagogic.”
.. He has so brazenly lied, so nakedly appealed to bigotry, and so frontally challenged the rule of law that he has made the elite media’s decorum absurd. He’s turned highbrow journalists into referees in a World Wrestling Entertainment match.
.. Since Trump has largely stopped giving interviews to anyone except campaign sycophants and celebrity lightweights, the debates may serve as his last encounter with actual journalists. Those journalists—Lester Holt, Martha Raddatz, Anderson Cooper and Chris Wallace—must be prepared to confront Trump in ways they’ve never confronted a candidate before. The more audaciously he lies, the more audaciously they must tell the truth.
Suppose it is dinnertime, and the phone rings. It is a polite survey taker with a simple question for you: How is the economy doing?
You might answer the question based upon the news stories you’ve seen recently about the latest unemployment rate, or perhaps based on anecdotal observations, such as whether your long-jobless cousin has had any luck finding work.
But a wide range of academic work suggests a different factor that is likely to shape your answer: whether the current occupant of the White House is of your preferred political party.
.. And it could even have implications for the economy itself if, for example, conservative-leaning business executives freeze hiring or investment when the president doesn’t share their politics.
.. When survey respondents were offered a small cash reward — a dollar or two — for producing a correct answer about the unemployment rate and other economic conditions, they were more likely to be accurate and less likely to produce an answer that fit their partisan biases.
In other words, when money was added to the equation, questions about the economy became less like asking people which football team they thought was best, and more like asking them to place a wager. Even a little bit of cash gets people to think harder about the situation and answer more objectively.
.. The paper by Mr. Bullock, Alan S. Gerber, Seth J. Hill and Gregory A. Huber found that offering a $1 payment for a correct response and a 33-cent payment for an answer of “Don’t know” eliminated the entire partisan gap between Democrats and Republicans on questions about the economy.
