Several police officers take it upon themselves to detain Philip Turner to force him to produce identification, even though they tell him that they know he is a first amendment auditor.  (They disparage his YouTube legal education and tell him “this isn’t working out like you expected”.

When a cop says he’s not gonna argue with you, it’s because he knows he’s violating your rights and that he’s wrong. He’ll just throw you in a cage regardless, and let you have your day in court. Take away their precious qualified immunity, and watch the magic happen.

  • Sadly, this cop has been doing this to citizens for years, totally ignorant of the law. They, however, messed with the wrong guy.

8:44, Have him sit in the back of the car and lets go ahead an figure out who he is. Handcuffed and buckled up in a police cruiser, a reasonable person would believe they are under arrest not simply detained. But they did put you in the front seat so maybe a little gray area.

I am a 25+ year professional and degreed journalist- I don’t say that to diminish non-journalist 1A rights… no journalist has more rights than a private citizen. Conversely, no citizen has less rights than a journalist. My favorite 1A audits are the totally silent ones. A lot of “auditors” say they are going to be silent, but almost none ever remain silent. But a few have, and it was glorious. (In states that are not stop and ID.) I do know, however, that POC have to be more careful in every regard. (Lots of cameras and friends with cameras far away.)

As egregious as this whole incident was, what bugs me the most is that knowing they are in the wrong and can’t ID Mr Turner, they keep him in handcuffs for one more attempt and then lecture him. At the point they knew they were wrong, those handcuffs should have been off and Mr Turner freed without a second’s delay. Instead, it was another four minutes between the Officer Copsplain approaching the car and Mr Turner being taken from it. If I was on the jury, those 4 minutes would have cost the city a million dollars.

Did you notice the camera guy was still in those painful handcuffs while the cop has the audacity to not only try to copspain away his illegal activities but he also stands above him, looking down at him like a parent with an unruly child, and lectures AT him for a while. I love how the cops always pull the “you may have a medical condition ” and we may have to have you checked out. Once those words are spoken, you have the cops scared.
“How are you expecting this to play out?” I expect you to know, follow and uphold the law, Officer. If you cannot or will not do so, I expect you to either relieve yourself of duty or be relieved.
This is what happens when you live in a society that requires the person who cuts your hair to have more of an education than the ones who are given a gun and told to uphold law and order and protect and serve the people. I wish a university would do a deep dive study into the personality types who become cops. There are plenty of good cops but we have a abundance of evidence that certain types of people go into law enforcement because they feel it gives them power over people.
That part at the end where the officer says “you can buy a copy of the report”… That’s the exact reason we need to record. They put layers of red tape and can deny FOIA requests for whatever bs reason they come up with. It’s always funny how when people want body Cam footage it takes forever to get released but if the footage clears an officer it’s out immediately.
Did I hear that correct? The settlement was $5500? If so, that is a rounding error for a department that size. They spend twice that annually on fuel for just one patrol vehicle.

Petty Officers try to Arrest Woman For Filming

It’s bad cops like these that puts targets on cops backs not law abiding citizens. Those cops would be doing the community a great service if they spent less time in the tattoo parlor and more time in the law library learning and understanding our rights

Once again police “need to know” who you are. Police for some reason have decided that they need to “know” who everyone is. What they forget is the PUBLIC sees it as INTRUSIVE behavior.

Since the Floyd murder most states made things worse. Except for one state the police that violate the laws that they swore an oath to uphold are now indemnified (Held harmless.) Their employers pay the fine that in most states is capped at 2 million dollars. (The Floyd murder was 27 million.) One state has the bad cop pay a pittance while the department pays the rest. Bad cops still are not punished for violating rights. The civil rights committees (deck was stacked) were weighted heavily with retired or current judges and officers. This is how the wool was pulled over the eyes of the public when they, “Stripped Qualified Immunity.” Still there is no punishment for the bad cops. The departments get off cheaper with the money cap on awards. The victims were stripped of just compensation. Bad cops aren’t hurt, departments are hurt less, and the victim’s got the shorter end of the stick.

I hope she sues but good luck finding a lawyer in Memphis that will stand up and protect her constitutional rights.

  • 20:16 the guys own words, says: “their whole tone changed when you arrived”. That is the protection of cameras!

 

  • 05:03 cop: “you’re just trying to find something wrong with this investigation.” Seems like a strange thing to say while trying to find something wrong with a citizen.

  • We need more people like this guy who cares about the rights of other people as if they were his own, which they are.

 

  • Everyone of these officers’ actions proved they knew they were being unlawful on camera and then tried to fabricate charges against lawful activity.

 

  • It is obvious to me that the officers are engaging you in conversation to distract you and block you from recording the encounter. Then they get butthurt when they realize you know the law. I think it would have been a very different result without the camera.

    • Italy: 4 years
    • USA: 21 weeks, on average.
      • As short as 16 weeks.
      • And we are surprised at how ignorant of the law most officers are in the US.

How dumb do you have to be to arrest a guy for filming a police station, as he is literally handing you a card and explaining the Federal case law, the case that HE WON, that recognizes an individual’s right to film the police and police departments?

Would love to see the looks on their faces when they realize they cited the guy whose name is on the case law that makes it a civil rights violation to have detained him.

It’s terrifying and upside down when a city ordinance can supersede a federal law. That’s like saying murder is legal but only on your own private property.

You cant even be around patrol cars? AND they park them near the entrance… So it’s illegal to enter the PUBLIC BUILDING?!

Turner v Drivers is clearly established in the Fifth Circuit but the Republicans in state legislature are beginning to challenge this constitutional rights of freedom of the press for citizen journalist. Ohio, Georgia, and Florida are considering similar laws. We are looking for The Battousia to handle our business for freedom. God bless The Battousia!!! It is amazing how ignorant law enforcement officers are concerning the basic principles of the Constitution which underlies are systems of governing. This is a blatant disrespect for the rule of law.

And since Turner v. Driver has been established, they don’t get qualified immunity, right?
