Well done sir! A very thorough job. I may have missed it, but was any disciplinary action taken? My biggest disappointment with disciplinary action, in the rare event that any takes place, is that it focusses solely on the bad cop – it never includes the other cops stood around who, by training, should recognise that the cop is wrong & step in. To me, they are equally guilty by being complicit in his actions. Indeed, if it were the other way round, any of your attending colleagues would no doubt be arrested for conspiracy. Perhaps a small issue in the grand scheme of things, but it really boils my piss.

That supervisor was an outstanding Leo. Rare in this age.
This is how Auditors should act, at no time did he purposely antagonize the Police Officers and he complied with their orders (he did everything right) – The Auditor has my respect in this instance. I applaud the Supervisor for recognizing the law and respecting the Auditor’s rights, acting like a gentlemen the whole time.
The sad part is the taxpayers pay for their mistakes.

I’d like to compliment the supervisor for knowing the law. Immediately he schooled the cop who arrested you. But he also handled it professionally. Another example that there are good and knowledgeable officers on out there. That makes me happy!
Congrats… it’s great to see that Leo’s are held accountable and that policies need to be changed. It would better great to take a few of these wins and present them to other city councils in that area or state to see if they can encourage a policy review for other depts and their training on how to handle public videography.
The fact the police all over the globe truly believe that the buildings for public interest, made with tax payer money, are privately owned by the government as if it’s a military installation is like believing in Santa Claus.

It would have been nice if the police depts would do away with department POLICIES and follow constitutional law instead.
Was that dumb cop saying “and I’m fine with that” to the supervisor in reference to picture taking? if he’s fine with that, why did he get physical, then proceed to shackle the man? Did he realize he screwed up while talking to the superior and say that in an attempt to downplay what he did and seem less hostile? How is it possible for a cop to be unaware of so-called auditors?
My 2 cents: holding a camera, having an internet presence, or being an activist shouldn’t matter. Police must stop detaining citizens illegally during their fishing trips. I’m very happy this auditor has made a change but do we all have to live stream our daily activity to ensure police won’t violate our rights?
Supervisor recognized you, knew exactly what you were doing and what your YouTube handle was. It would have been nice if he’d shared his knowledge with the rest of his department before it cost the Pueblo taxpayers $41,000.00.

I had seen the original video but not this followup – holy shit their policy before Red-Lines was completely a violation of rights – I feel bad for officers that had such poor guidance to follow.
Seizure policy is horrible, it has a carve out to allow police to seize recordings without a warrant, by stating that they must secure a warrant within 72 hours of the seizure which already happened WITHOUT a warrant.
Most of these videos I have seen, YOU (the First Amendment auditor) expect to be treated with the utmost respect but you treat the officers like dirt. This auditor, when approached in what I would consider to be a non-confrontational manner by the officer and greeted in a non-aggressive way, instead of answering a simple question which would probably have resulted in the officer talking to you for a brief period of time, you turned your back and began walking away. Your reaction was that of somebody who may have been committing a crime or considering committing a crime, which would understandably raise certain suspicions in the officers mind. A simple “I am taking some pictures” response may have been enough to send the officer on his way without further incident. In my opinion, YOU were the one who escalated the situation to what it became. Was handcuffing you wrong? It was an over reaction but I believe your being courteous may have gone a long way to preventing that.
It’s fair that they would reach a settlement, though – can’t detain someone when there’s been no report of a crime nor any reason to suspect one, and it’s pretty blatant that there hasn’t been. Cops can stop you for questioning but they can’t really detain you or stop you from leaving when there’s no lawful reason to do so.
Nice job. However, that would be considered and arrest under the law and court precedent. Not a simple detainment. People need to research this and understand it. Hope that helps.
It must be mentioned that when the senior officer arrived, and listened to the vacuous explanation given to him by the arresting officer, as to why an innocent citizen was In cuffs, he seemed well aware of the 1st amendment auditing community and there “strike force”, which makes me wonder why the hell he hadn’t taught the officers under his command to leave auditors alone. That shows that his leadership is poor, and that he underestimated the impact an auditor could have on his department, both financially and in terms of negative publicity, if they illegally detained citizens. The arresting officer, like the majority of cops in the US, had an IQ that would struggle to reach room temperature in a heatwave. He is the kind of cop who would be struck dumb if you asked him to name the top five authors of the books he’s read in recent years. Or if you asked him to name a county beginning with a U. He enforces his emotions and ego not the laws , which he forgot about half an hour after he graduated from the academy. The only way to officially win in the battle to return America to “ THE LAND OF THE FREE “ is to make law enforcement pay in hard cash and to force them to rewrite there policy out of shame. You achieved this and more, which is as rare as rocking horse shit. I congratulate you for all the people fighting to maintain there rights under the law and bill of rights. “ Make America free again”

The supervisor knew who you were immediately. He is probably a long time subscriber. Makes you wonder how many cops around the country trying to do the right thing look for videos like this.
There is only one thing I would want to see added to the list of changes: Any officer who sees a fellow officer violating these rules MUST IMMEDIATELY release the subject, or face the same consequences (suspension up to termination) as the offending officer”. This will prevent instances such as 1:55 “Can you tell this officer to take his hands off me and to uncuff me?” “No, I don’t want to tell him anything”.

Wow.. that was a fast payout. I can’t say that I wouldn’t take the money.. but by u accepting the settlement, the party responsible faces NO legal consequences for their actions. You probably could have got charges pressed against him and filed a civil suit had u not settled. Either way, maybe this department learned a valued lesson. Nice work 👍

“I got one in custody here”..what did he do? “Take a picture in public”…do these guys not understand how ridiculous this is? Beyond ridiculous..
The cuffing ociffer says “I’m fine with that” when the supervisor explained what was going on but yet apprehends and detains a man taking pictures from a public sidewalk and ignoring his unlawful commands. So he’s fine with nabbing a citizen and cuffing them for something he is “fine with” them doing. Any 8th grader can pass the test required for civil service, law enforcement and military employment. No useful intellectual skills required.
The funny part is that most of their ” new policy” is already covered under the 1st amendment. It was already legal to record from public places, so what makes anyone think this is going to change anything. They were violating the rights of people already, nothing will change with this piece of paper.

I have said time and time again. And will say it till something is done about law enforcement today. In this day and age ( as the cops always say ) we no longer have police that protect and serve. We don’t even have law enforcement. What we have is ego tripping out of control bullies with guns and badges ,that use gestapo tactics on the public that pay them. The police are no longer professional officers. They are gang members out to get you . And they wonder why there is a disconnect with the police and the public.. Why do police officers always react so aggressive when someone has a camera
If this comes from the insurance policy it may raise their premiums or they would just keep asking for more money or write more tickets. Another thing is if more people do this and take it to court the cops and judicial system would get bogged down so much they would ask for a raise or just stop harassing because it is not worth it. Good job filming keep them accountable.
I believe the $41,000 is paid by their insurance company, I would think that the insurance companies would take a closer look at why they pay out for false arrest so often, because they certainly do when someone gets a number of traffic tickets.
Although taxpayers pay these are still the most satisfying videos. Cops should have to pay at least a portion of all settlements even if its 5%.
i just wish the offending cop would pay a fraction of the settlement from his own pocket this would make all these cops think a little harder before putting their hands on people
What’s up with Colorado? this is the second time I have seen them payout $41,000 to an auditor who was illegally detained, why not all the other states, do they have outside insurance? if so how do we get all the other states to get insurance?

Seems Colorado is among the easier states to get any settlement from wrongdoings by the police… Other states’ prosecutors would go bonkers and file any made up charges to get some kind of conviction. Oh,, plus shop for judges.
Most police officers are not educated enough to do there job properly. In this case I believe the city should pay for this mistake, not the officer. Auditors are cancer, not experts on the law. They research specific laws and rehearse before they go out and bait police officers by doing something out of the ordinary and weird looking. If they’re lucky, they make a quick buck by doing it and potentially ruining someone’s career. It’s an officers job to know the law I agree, but they’re not lawyers. If something wrongful happens to you by a cop then take it to court, don’t bait a police officer it’s disgusting and pathetic. 6 Police Officers Respond to a Freedom of Information Request

It took 45 minutes, 6 police officers, and 5 office staff to field a FOIA request.

The police wanted to solicit a disorderly conduct charge because he swore and talked back to them after the clerk invocked his mom.

I know some people will give this auditor a hard time about professionalism but the female clerk mentioned something about the auditors mother. The disrespect and unprofessionalism by the clerk was uncalled for and the give what you give approach is what this auditor did. Some people do like this style while some do not.

 

If you give an inch they take a mile. This guy shows the power of knowing your rights. He completely mentally disarmed about 6 different police officers in a 20 minute video. People get the same respect they give and that clerk is rude as hell.

 

I don’t understand why so many people in the public think this guy isn’t trying to protect their rights? People will say “ oh he’s just trying to be trouble” when in reality if the public workers treated the way they do everyone without a camera nothing would have happened but paying getting his copy and leaving. Why does a camera mean he doesn’t get served or cops called on him?

As a retired police officer, with over 20 years of service. This video is 100% correct. I was constantly, battling my “alleged” superiors (they hated me), over what the law states vs. their personal opinion. So many times, I was told/ordered… “Do as I say, not as I do” Ad-nauseum! That’s why I retired early. I worked for three separate departments and they were “ALL” the same! The only thing I learned I was going to continue to do, what was right (follow the law). Not what was popular by a bunch of ignorant/god complex supervisors. Supervisors who were the first to put an officer under the bus to avoid taking responsibility for their own actions! That’s known as… A FACT! I speak from over 20 years of dealing with that CRAP!!!

 

the only way this will stop is if it is MANDATORY that all cops state the actual law that is being broken when first contacted. Then if your recording you have the so called law on record.On traffic stops the first thing out of the officers mouth should be why he or she pulled you over. If not stated then the driver should be let go.Also needs a law that cops cannot touch your vehicle at any time during the stop. Always seemed to me of planting evidence on personal property.

 

When cops start losing the argument they go straight to open ended questions in the hopes that if they do it long enough you will eventually lose patience and THEN they get you for disorderly, etc.

 

he is well known to the police there. he has the right to get the video anonymously and thats why he asked for it anonymously , not because he need to stay anonymous. the video he asked for is from a police station where police attacked him without he doing anything wrong. (they ambushed him also on the streets, crazy ambush without warning) thats why it took so long to get this video, the police fucked up big time there and he has all on video. the whole town conspires against this man, the city attorney, the police ,… i went in rabbit hole on his channel the other day and thats one crazy ride all his intereactions with public servants on this matter. i can say you this man has absolutely no fear and this story will be a good one, because he documents every step and he does his law suit and complain every time and he will win in the end-

 

I cant believe it takes that many people for one simple request.

 

This is what happens when people take the attitude of: “we talk; you listen”. If instead one or two of these employees had spent a little more energy listening then they would not take an hour to produce a copy of a piece of paper.

 

They tactically surrounded you. You should’ve questioned them on their hostility. There was no need for that.

 

I would strongly advise the auditor to always bring a friend, and have that friend be completely silent while recording

“Give what you get” is one of the first principles that kids learn in kindergarten. As they mature, some kids learn that they can better accomplish their goals by not playing or joining in that game.

He should have at least let the cops know the clerk was talking about his mother, and so he was returning that vibe.

The worst part of interactions like this is that the private citizen is citing laws that are actually being broken by public servants and the public servants are citing bogus charges against the citizen.

To charge a person with disorderly conduct there has to be a threat of imminent danger.
In NC there’s a law thst says if ya cuss a cop you can be charged with assault on a cop.
In this case, the cop could ask the man to stop cussing, but not demand it. Or call it disorderly conduct. That’s suppression of free speech. So is the law in NC.

He CLEARLY heard something he could take and run with to ratchet up the confrontation and went 10x beyond what her little transgression reasonably called for, let’s be real. That innocent smile the last cop has while she tries to set the guy up to allow her partners to ruin his life and maybe end it , that’s terrifying: she is trying to create a situation where she can claim she was attacked so she can shoot that guy!

I am a former cop. No way would I ever open the door for the cops. No way. I have nothing to say to them and they have nothing to say to me. I learned that at the police academy.

Before channels like yours I honestly thought police had the power they act like they have. And it’s frightening for me to deal with them. Because they hold the power to ruin innocent peoples lives.

It is time for Cops to be held accountable abolish immunity We the people do not have to pay for their mistakes and ignorance of the law by violating our rights that they swore to protect

That blank look on that cop’s face when she said, “that’s fine”. That’s fine, is one of their go to lines when they are ignoring the public.

Did you see that one where the cop just wanted to look in the kitchen for him for just 2 seconds. She said ok come in. The police did a full search of the house despite her yelling for them to get out!!!!! Never let them in!!!!!

Never never ever open the door to the cops. You have NO obligation to open the door or even talk to them through the door.

The assault laws in this country need to be such that the owner of a house can PHYSICALLY remove a cop with NO business being there ONCE the owner has declined to engage in a conversation. This is BS! I know of few places where a home owner can physically remove a civilian, yet with a cop, it’s a crime! BS!

If they don’t have a warrant, don’t open the door. If they get a foot in, you’re screwed. If you don’t open the door, say “Leave now” and ignore them.

Absolutely right. The more they knock, you know they are serious about something that they WANT YOU for. If they knock and leave, it was not about you or important. And tell them “I don’t answer questions”.

Cops will push verbally or physically to get their way. They don’t care if its right or wrong. And when they are wrong, YOU will have to hold them accountable if they are going to pay for their actions.

Even worse, once you open the door the cops can lie and say they smell weed or claim to see something illegal.

That last clip is a perfect example of those type encounters. The guy knew exactly what she was doing and called her out on it. Everyone should listen to Q, never open your residence to a police officer.

Without warrant they are just like anyone else. Without a warrant they have no right to enter or remain upon your property when told to exit, unless they witness something that makes an exigent circumstance. Unless there’s a warrant or a well defined exigent circumstance, they are just another other human. If they remain in or on said property after being told to leave then they are armed trespassers and an immediate threat to the security and safety. It doesn’t matter what question(s) they wish to ask, who/what they seek, or what gibberish they speak. They have stepped beyond the powers and authority of their office and have now taken up the title and role of criminal.

I used to totally support the cops but after neighbors calling on me for no reason I’ve learned to not answer the door and that ends the situation.

I have seen so many of their foot in the door tricks lately, that I thought they were actually selling vacuums. That being said, I learned on another site that you lose very important legal protections, once you step outside your home.

To be fair, the woman in the first clip didn’t open her door; the cops opened it and entered.

I just don’t answer the door simple as that and if they show up when I’m leaving or coming I just continue to leave or come don’t answer questions even if you might have thought you broke the law not knowingly never answer questions only person you need to answer questions to is your personal lawyer no one else

The part i really really love about the young man at the door is when he tell the officer ” this is ALL ON VIDEO and it will show iv asked you several times nicely to leave, as soon as he says that, watch her face change and imediatly leaves his front door. First words out of your moth are, “leave my property”, when they don’t leave, the next words that are repeated over and over are, “you are trespassing, leave my property”.
As you are saying that you call 911 and report that you have an armed home invasion in progress and they refuse to leave. Use the law against them.

Notice: the lady officer did not stop breaking into that mans home until he informed her that she was being recorded

Any cop that puts their foot through the thresh hold of the door is breaking the castle doctrine and can be sued directly and can’t use c.i to protect themselves because they knowingly broke the law and violated not only your 4th amendment rights they violated the worst of them all the castle doctrine

>> You are describing a situation where “law” and “rights” exist. IF the 4th amendment was so great, RARELY (close to zero) would an officer put their foot over the threshold. Best to prevent this by keeping your door and your mouth shut.

This is why we need to reform the police, the lady blocking the door is actually breaking the law, you have every right to shut to door in their face if they don’t present a warrant, you have every right to not answer the door to cooperate or answer any questions, these officers have this illusion that everyone has to respect and obey them when you actually have the power the use your firearm against an unlawful arrest or entry into your home as you would against any civilian during a break in or robbery

Don’t open it. If they wanted you, they wouldn’t be knocking! Once you let them in, they can walk through your whole house because you gave them permission to enter! Ignore them, let them knock!!!

5 years ago, I had 2 brainless badged thugs show up to my house; demanding to talk to someone who I didn’t know; and even when I explained I had no idea who they were talking about ; they were demanding to speak to this person. I was getting ready for a fight because they wouldn’t quit insisting on the person being at my house. It could have gone very wrong, but they eventually left after radioing their supervisor; he told them to leave.

Giving everybody here a time reference. The last time the cops came to my house, I sat silently where they could not see me and they pounded on the doors and windows for 23 minutes. Your mileage may vary.

So much truth in the words and the actions seen in this video… Its so sad you can see the officers were desperately trying to create a unsafe situation and people do know now how officer jump or put their body in the way to say they were assaulted where whey felt the feared for their life which ended up in a shooting… The African American male nor female can’t trust police officers with the heightened attacks murders assaults from white supremacy, race soldiers, etc… How can people trust someone that is know for murdering them… I dont blame these people for standing up for their rights that are suppose to exist for them as well as we Caucasian people. Its only fair to treat all with respect and with dignity. 👍 Too much has went on and its hard to trust anyone even during the pandemic… Safety first…😉

It is illegal for the police to put their foot in the door when you do not want them in your house. That is crossing the threshold so they break the law on video and never get it trouble for it . Why not?
