Former U.S. district judge John S. Martin, writing in The Post to debunk the baseless proposal by House Freedom Caucus members to impeach Deputy Attorney General Rod J. Rosenstein, observes:
The actions of the Freedom Caucus members are not only baseless, they are also shameful. While they call for the appointment of a special prosecutor to investigate Rosenstein, it may be more appropriate to appoint a special prosecutor to investigate an attempt to corruptly obstruct justice by members of Congress who so obviously use their office to intimidate the deputy attorney general and to undermine the credibility of special counsel Robert S. Mueller III’s investigation.
.. Their inexcusable acts include:
- The caper by House Intelligence Committee Chairman Devin Nunes (R-Calif.) in which he scurried over to the White House to review classified documents and then tried to push the fake “unmasking” scandal;
- Nunes’s memo falsely stating that information about the Christopher Steele dossier’s origins was omitted from the Foreign Intelligence Security Court warrant application to conduct surveillance on suspected spy Carter Page;
- The outing of a confidential intelligence source;
- The badgering of Rosenstein for documents from an ongoing investigation and the bogus impeachment articles cooked up by Reps. Mark Meadows (R-N.C.) and Jim Jordan (R-Ohio);
- False accusations against the FBI (e.g. accusing FBI officials of aiding Hillary Clinton in the campaign) that were discredited by the inspector general’s report; and
- Refusal to obtain relevant documents (e.g. the blocked phone number that Donald Trump Jr. called in close proximity to the Russia meeting in June 2016).
.. Congressmen, Trump lawyers and White House aides conferring with intent to mislead investigators and the public, to disable the inquiry and/or to discredit law enforcement sounds an awful lot like obstruction of justice. Conversations or documents relating to that sort of conspiracy are in no way privileged.
.. Norman Eisen, Laurence Tribe and Caroline Frederickson wrote in February: “Endeavoring to stop an investigation, if done with corrupt intent, may constitute obstruction of justice. Plotting to assist such action may be conspiracy to obstruct justice. Normally, what is called ‘speech or debate immunity would provide a strong bulwark against any such liability for Mr. Nunes or his staff.” However, they argued, “Mr. Nunes and company may have ranged so far afield that those protections no longer apply. Under the clause, mere peripheral connection to legislative acts cannot serve as a fig leaf to shield criminal conduct.” They argued that if “a member or staff employee of the House Intelligence Committee engaged with the White House to stifle the special counsel inquiry, it would be difficult to see how such collaboration would be” protected by the speech or debate clause.
.. An investigation into Republican House members’ antics is critical if we want to hold them responsible for actions injurious to our criminal justice system. It is also necessary in order to uncover who if anyone they were colluding with on the White House side of the operation. Any White House official and/or lawyer — with or without the president’s knowledge — scheming to obstruct the investigation in concert with members of Congress needs to be investigated and held accountable.
.. Rather than simply play defense on behalf of Rosenstein and the Russian investigators, defenders of the rule of law need to go on offense, demanding Nunes, Meadows and Jordan come clean on their actions in support of a president trying to thwart a legitimate investigation. It all needs to come out.
Mike Pence, Holy Terror
Are you sure you want to get rid of Donald Trump?
There are problems with impeaching Donald Trump. A big one is the holy terror waiting in the wings.
That would be Mike Pence, who mirrors the boss more than you realize. He’s also self-infatuated. Also a bigot. Also a liar. Also cruel.
To that brimming potpourri he adds two ingredients that Trump doesn’t genuinely possess: the conviction that he’s on a mission from God and a determination to mold the entire nation in the shape of his own faith, a regressive, repressive version of Christianity. Trade Trump for Pence and you go from kleptocracy to theocracy.
.. The book persuasively illustrates what an ineffectual congressman he was, apart from cozying up to the Koch brothers, Betsy DeVos and other rich Republican donors
.. the strong possibility that he wouldn’t have won re-election; his luck in being spared that humiliation by the summons from Trump, who needed an outwardly bland, intensely religious character witness to muffle his madness and launder his sins; and the alacrity with which he says whatever Trump needs him to regardless of the truth.
.. In Pence’s view, any bite marks in his tongue are divinely ordained. Trump wouldn’t be president if God didn’t want that; Pence wouldn’t be vice president if he weren’t supposed to sanctify Trump. And his obsequiousness is his own best route to the Oval Office, which may very well be God’s grand plan.
.. “I don’t think he’s as resilient, politically, as Bill Clinton was,” D’Antonio said. “He doesn’t relish a partisan fight in the same way. He loves to go to rallies where people adore him.”
There’s no deeply felt policy vision or sense of duty to sustain him through the investigations and accusations. “If the pain is great enough,” D’Antonio said, “I think he’d be disposed not to run again.”
.. It suggests callousness at best toward African-Americans. As governor, Pence refused to pardon a black man who had spent almost a decade in prison for a crime that he clearly hadn’t committed. He also ignored a crisis — similar to the one in Flint, Mich. — in which people in a poor, largely black Indiana city were exposed to dangerously high levels of lead. D’Antonio told me: “I think he’s just as driven by prejudice as Trump is.”.. he rallied behind the unhinged former Arizona sheriff Joe Arpaio. In a speech he called Arpaio a “tireless champion” of the “rule of law.” This was after Arpaio’s contempt-of-court conviction for ignoring a federal judge’s order to stop using illegal tactics to torment immigrants. The conservative columnist George Will seized on Pence’s speech to write that Pence had dethroned Trump as “America’s most repulsive public figure.”.. You can thank Pence for DeVos. They are longtime allies, going back decades, who bonded over such shared passions as making it O.K. for students to use government money, in the form of vouchers, at religious schools.Pence cast the tiebreaking vote in the Senate to confirm her as education secretary... Pence once spoke positively on the House floor about historical figures who “actually placed it beyond doubt that the offense of abortion was a capital offense, punishable even by death.” He seemed to back federal funds for anti-gay conversion therapy. He promoted a constitutional amendment to ban same-sex marriage.“He is absolutely certain that his moral view should govern public policy,” D’Antonio told me.
.. Pence sees himself and fellow Christian warriors as a blessed but oppressed group, and his “hope for the future resided in his faith that, as chosen people, conservative evangelicals would eventually be served by a leader whom God would enable to defeat their enemies and create a Christian nation.”
.. Is America worse off with Trump or Pence?
“I have to say that I prefer Donald Trump, because I think that Trump is more obvious in his intent,” he said, while Pence tends to “disguise his agenda.”
Donald Trump trusted Michael Cohen for years. Now his lawyer doubts Cohen’s credibility.
On July 8, ABC News’s George Stephanopoulos asked President Trump’s lawyer Rudolph W. Giuliani whether he was concerned that Trump’s longtime lawyer, Michael Cohen, might flip on the president.
“I have no concerns that Michael Cohen is going to do anything but tell the truth, and if he does, as I said, there’s no suggestion that anything happened,” Giuliani said at the time.
Now with Cohen reportedly prepared to flip on Trump less than two weeks later, Giuliani is singing a much different tune about a man he once called an “honest, honorable lawyer.”
“This guy is a proven liar,” Giuliani told CNN on Thursday. “A year ago, when I wasn’t his lawyer, people in your profession told me this guy will flip because he is an inherent, pathological liar.”
.. the investigations into Cohen and Russian election interference could come down, in part, to Cohen’s credibility. Or at least Trump’s legal team seems to think so.
What Doesn’t Kill Him Makes Him Stronger
The more Trump lies, the more he is empowered to lie.
Facts don’t matter to millions of Americans anymore. That is just the truth. Republicans bewitched by Donald Trump have devalued the import of truth.
It is a sad truth and a dangerous one. What is the operational framework of a society when the truth ceases to be accepted as true?
There may be precedents in other countries, but one would be hard pressed to find a precedent here. It is becoming cliché now to say that we are in uncharted territory with Trump and his regime, but that is precisely where we are.
.. Every day there is no catastrophe, every day yet another never-before-seen, outrageous scandal emerges from this administration and Trump is not destroyed by it, it strengthens him and numbs us and steels his supporters.
The more he lies without paying a price for it, the more he weakens the power of the truth to defend right and condemn wrong. And he expands his latitude to lie more.
.. Rather than lying less, Trump is increasing the frequency of his lying.
.. Trump has gone from making 4.9 false claims a day to now making 6.5 a day.
.. “Just stick with us, don’t believe the crap you see from these people, the fake news,” before telling them, “Just remember, what you are seeing and what you are reading is not what’s happening.”
.. he has used the power of the position to project a sort of hypnotic disregard and amnesiac self-delusion upon the people who follow him. So much of what Republicans once said they believed has now been betrayed.
.. He boasts about being strong while simultaneously whining about being assailed.
.. His griping, in a weird way, is what fuels his gasconade. He insists to his supporters that he is being treated unfairly and their reflexive defense of him prevents them from even entertaining the fairest of criticisms.
Indeed, the more Trump is rebuked by his opponents, the more his base rallies.
.. Among [Republicans], 64 percent strongly approve of Trump, who is experiencing an almost unheard-of level of support from members of his own party.”
.. The White House had previously denied any knowledge that McDougal had even sold her story. That clearly was a lie. Trump not only knew; he was discussing buying it from the seller.
.. Rather than cowering in shame at his deception and his unseemliness, Trump simply goes on the attack, tweeting outrage and indignation
.. We are all trapped, for the time being, held hostage by
- an empowered president,
- a self-neutered Congress, and a
- cultish horde of Trump voters.
But it is the vote that is the most likely way to curb this rolling tragedy. The midterm elections are only a little more than 100 days away.
